    Ok, outside my area of specialty then but I will take a punt based on the fact courts place a greater onus on vehicles and say the car... even though the bike suddenly appeared from behind the truck leaving no time for the driver and should be at fault.

    Were they not insured? Going to court to have your car repaired otherwise seems expensively excessive

    Yes that is true, I hadn't thought of that. In terms of real wear I'd imagine it would be minimal though, it's not as though bikes and their riders weigh a tonne.

    A 50 to 60 km/h combined speed impact is not soft for an unprotected body. Maybe high school physics is not Jimbo's strength.

    Mass, velocity and (de)acceleration are the major variables in what happens to an object during an impact, especially mass.

    Drop a mouse from a height equivalent of a ten story building onto concrete in human terms and watch it scurry away. Do the same to a human and you'll end up with a mush of blood, bones and organs in a bag of skin.

    My comment was in reference to the rider's speed, not the relative fragility of the human form to that of an automobile

    The truck driver was eventually found at fault after the initial blame being on the bike rider.

    Try this stupidity from a mob called the Bicycle Network.

    Victoria's cycling lobby group wants mobile phone signal-blocking technology in cars, but the premier is not convinced it's a good idea.

    Premier Daniel Andrews said such technology would be risky in emergency situations.

    "We have no plans to introduce changes like that," Mr Andrews told reporters on Thursday.

    "That would seem to me a very big step and one that would have a whole range of technical challenges - you know how would you cut out emergency service vehicles for instance, in that sort of a comms ban?"

    The Bicycle Network said a new report by the federal government, which forecasts more deaths on the state's roads due to mobile phone use, proves the need for the technology.

    Do you have a citation for this case? Seems strange to me that the parked vehicle gets 100% fault in a personal injury case or no contributory negligence found for either of the other parties.

    It wasn't a personal injury case, just property damage. The car driver tried to sue the bike rider initially.

    Just letting you know that the incident occurred in about 1985.
