There is no argument that Djokovic, when he arrived in Australia late last Wednesday, was armed with a vaccination exemption provided by a qualified physician and infectious disease expert provided by Tennis Australia, and a letter from the Department of Home Affairs confirming his paperwork appeared to be in order.

He had recently recovered from a COVID-19 infection and by the reading of health guidelines by the Tennis Australia panel, did not require vaccination for another six months.

Djokovic’s medical exemption, endorsed by a separate Victorian government panel of experts, was based on the published advice of the Australian Technical Advisory Group on Immunisation, a group of scientists who throughout the pandemic, has advised the federal government on how and when to inoculate the population.

There is also no quibble that the border officials who dealt with Djokovic once he disembarked inside Melbourne Airport had discretionary powers to overrule whatever documentation the Serbian pulled from his carry-on luggage.

If they thought he might present a health risk by coming to Australia, they could cancel his visa and put him on a plane back to Dubai.



So what is the health risk now? Or is it a loss face of the Government and Scott Morrison?

One of the officials said he wanted to resolve the issue before he finished his shift.
“It is not a case of time being denied,” the judge said. “It is in fact, objectively, broadly, an agreement to give time which is then reneged upon.

“It has the quality of this ex post facto view. We have these people saying ‘look, getting in touch with your lawyers is really not going to help any of this so why don’t we just get it done’?”
This was the point that broke the government’s case. Mr Tran, having sought an adjournment to prepare his response, returned to court with the news that Ms Andrews had conceded the entire match.

Ex post facto is sharp language for any judge. Within the Latin lies a thinly veiled suggestion that Djokovic was stitched up.


Like I have been saying for f**king years. They don't like him. They never have. He has been demonized for a long time now and as the Judge said in Latin, STITCHED UP!!

Wait, the panel was appointed to advise on the entry to the tennis tournament.

He then used that as evidence to gain entry to the country. The panel took various medical certifications as prima facie and did not question the quality if the evidence. The border, who are used to testing the validity and compliance of documents, drilled into the evidence provided and were not convinced that the entry requirements had been met.

The court today viewed the matter as a case of equity and if he was treated fairly. The judge did not examine the documents or seek to test validity or compliance.

If they let him stay it’s because of the international embarrassment. If they let him stay they are weak and have given to pressure to a rich guy, yet have people held in custody without a voice now for 9 years. If they kick him out tomorrow because strong borders, then they are still f**ked.

The antivaxers see that this is a win for whatever they are spooked about this week. But it’s got nothing to do with it.

Not sure if you're offering that as a reason (for sticking with Scummo) or as your voting intention... but surely, surely even rusted on LNP voters have been embarassed by the absolute shambles of the past 3 years?

Either way, hopefully people aren't gullible to be fooled again by the tsumani of spin that #scottyfrommarketing will have ready to roll between Feb and May...
Labor should have won the last federal election but said and did too much rather than letting the incumbent fall on their sword...(lol sword).

They'll have learnt from that this time around.

This whole debacle shows the perils of trying to play populist politics all the time.

Without any details, plenty of people were roasting Novak and thought it was a disgrace to let him in. PM and others would have thought this is an easy way to win a few people over. They didn't factor in the backlash nor consider how easily people change their minds. Or maybe they fooled themselves into thinking that twitter gibber reflects what people think in the real world.

Either way it is a truly embarrassing situation.

I have to say I felt the turning point was when Shortens come out with his speech about wanting or becoming lawyer and this big sob story and how he battled to get there. It was to mush and made everyone sick....

I have a few extreme Labor friends. They are all about saving the planet yet will leave air cons and power running when out. Are all about equality and hate capitalism yet never shout a beer and own multiple investment properties.
Along with so many f**kwits around here who think by having Labor in their whole world will change.
You know what gave me JOY? Seeing all there little home election parties ruined while they choked on there cheese platters.

I couldn't care less who is in power. I don't understand the benefits of either. And never felt much of a change to anything whenever one or the other was in charge. The wheel keeps turning.

Yes, it's quite amusing that on January 5, Scomo is telling journalists that the issue of exemptions is up to Victoria.


Asked whether the world No. 1 had received an exemption, Mr Morrison said on January 5: “Well, that is a matter for the Victorian government. They have provided him with an exemption to come to Australia, and so we then act in accordance with that decision … That’s how it works. States provide exemptions for people to enter on those bases.”

Well, yeh, one person has definitely broken the rules. The bloke who told him that he had til 8.30am to respond, but woke him up earlier and told him that he had to act now.

If anything the chaps at the airport need to be knuckled, but ^^^ should not entitle the applicant a get out of jail free card. Ultimately, the matter must rest on the law. Is he entitled to cross the border ?
