The state government has signalled plans to compulsorily acquire the site of the old Balmain Leagues Club in inner Sydney as an entrance way for a tunnel needed to remove thousands of tonnes of spoil each day during construction of the proposed Western Harbour Tunnel.
A compulsory purchase of the notorious eyesore on one of Sydney's busiest roads will shelve new plans for the Balmain Tigers to return to their traditional home, and expose the state to a hefty payment for a property slated for a $160 million redevelopment.

Roads and Maritime Services notified the Inner West Council that it is likely that the Rozelle property, which is about to be taken over by a new owner, will be acquired for a "dive site" for the planned toll road tunnel under the harbour between Rozelle and the north shore.
Inner West Council's Labor mayor, Darcy Byrne, said a compulsory acquisition would have "disastrous consequences" for the Balmain Tigers, the Rozelle community and taxpayers.
"If the government snatches the property and uses it as a 'dive site' for tunnelling, this development will never proceed and the Tigers will never return," he said.

Mr Byrne, who is opposed to the new road tunnel and the WestConnex motorway, said it would lead to a surge in trucks on Victoria Road and local streets as they carried away millions of cubic tonnes of spoil excavated during the tunnelling project. "It is going to be like building a mine in the middle of a densely populated inner-city suburb," he said.
Heworth Group has bought the site from Rozelle Village, which was at the centre of a long-running dispute about the scale of development at the prime inner-city property.

Heworth will take ownership of the site on March 20, and has proposed building three 12-storey residential towers, a supermarket and commercial offices on the site. Under its proposal, the Balmain Leagues Club would return to its original home, which it was forced out of in 2009 amid plans by the then Labor government to build a metro station.
Balmain Leagues Club chairman Leslie Glen said the board had been in talks with the new owners of the site and it would be a "terrible frustration if our return was further delayed".
"We want to go back. It has certainly taken the wind out of our sails because the board was really starting to build up some optimism that we would get our club back to Rozelle," he said.

Roads and Maritime officials have sought a meeting next week with executives from Heworth and the present owner of the site, Ian Wright from Rozelle Village.
"We will go and listen," Heworth managing director Brian Hood said. "Our current view is that we will be proceeding [with his company's plans for the site]."
Roads and Maritime declined to answer questions about the potential aquisition, referring the Herald to the office of Roads Minister Melinda Pavey.
In a statement, Mrs Pavey took a swipe at Mr Byrne for choosing to "politicise this" but did not provide any further information on the government's plans for the site other than to say that it would "consult with the community and will have more to say in the near future".

The Western Harbour Tunnel is part of a 14-kilometre toll road planned to run from an underground spaghetti junction for WestConnex at Rozelle to Balgowlah in the city's north.
Peter Hehir, a Rozelle resident and convener of a group opposed to WestConnex, said a dive site at the old Balmain Leagues Club would create traffic chaos on Victoria Road.
"You couldn't possibly consider a worse area in which to be feeding B-doubles onto a major thoroughfare," he said.
The proposed sites in Rozelle for ventilation stacks for WestConnex and the new harbour tunnel have also angered residents. A 20-metre high stack is proposed for the centre of Victoria Road near Rozelle Public School, while three 35-metre high stacks will be built at the old Rozelle rail yards.
The Herald has revealed that the cost of the Western Harbour Tunnel and Beaches Link project is estimated in leaked cabinet documents at $14 billion and will be partly funded from motorists paying tolls on northbound journeys of the Sydney Harbour Bridge and the existing Harbour Tunnel.

Been a fiasco since day one, fuelled by greed, politicians,local government and self interest groups. You would hope the new owners have a get of jail clause in the purchase contract. Anyway you would have to think this will be curtains for the leagues club as I doubt they will get a cent out of the forced sale as it will go to the developers and the leagues c lub will be left with a stack of debt. Anyway as others have said it is karma for a lot of people

Developer ‘confident’ of resurrecting Balmain Leagues Club after lodging DA

A recent court battle has given confidence to a Chinese-backed developer, pushing ahead with a $135 million development application to redevelop the Balmain Leagues Club, despite its future uncertain with the government still looking into forcibly acquiring the site for a second harbour tunnel.

Heworth lodged its DA to the Inner West Council proposing to build three 12-storey towers on the Victoria Road site in Rozelle.

The proposed development includes a mixture of commercial floor space, 173 residential apartments including four affordable housing units, and a new leagues club as the centrepiece.

It comes after a beleaguered nine-year history of the now derelict club that has seen it wrestle debt, multiple development proposals, a court battle and a compulsory acquisition plan in 2009 by the then-Labour government for a metro station.

It faces the same fate yet again as the Berejiklian government earmarked it as an excavation site for the Western Harbour Tunnel despite being purchased for $75 million by Heworth last year.

But Heworth’s managing director Brian Hood said the state government’s plans are not right for the community or the site.

“The site has been sitting empty for nearly 10 years and it’s an eye-sore for the community. We’ve got a solution and it’s giving back to the community,” Mr Hood said.

“It’s much better than an excavation dive site for the RMS for eight years.”

He said while Heworth was always going to forge ahead with its plans to resurrect the club to its former glory with residential and commercial additions, the state government’s news did make them “pause for a moment”.

He said he was encouraged by fellow property developer Desane’s successful legal battle against the NSW government’s plans to forcibly acquire a large parcel of land integral to the final stage of toll road project, WestConnex.

“We’re not banking on going to court, we don’t want to go to court. But if it did go to court, other than the fact it would take another 12 to 18 months, we’re confident it would be approved,” Mr Hood said.

“The reality is the club was kicked out 10 years ago because of compulsory acquisition and we know what happened there … nothing,” he said.

Inner West Council Mayor Darcy Byrne said council was yet to assess the development but welcomed the progress.

“In contrast to the previous owner of the site, the new owner’s revised plans have made the club the centrepiece. It’s good and it’s encouraging,” Cr Byrne said.

“But I want to have a very close look at the proposal and get professional advice,” he said.

Cr Byrne said the state government has refused to brief council or consult the community on a forcible acquisition.

He said it would be a “disaster” for the community if the government proposal went ahead and the court ruling in favour of Desane was proof the government has acted improperly and illegally.

“It happens they’ve fought someone with deep enough pockets to win a case. The only thing that acts as a barrier from forcible acquisition is public pressure and we intend to ramp that up,” said Cr Byrne.

A Roads and Maritime Services Spokesperson said the state government was committed to providing the community with further details by mid 2018.

“It is prudent to explore vacant or abandoned property to minimise impacts and disruption to local communities when considering major projects,” the spokesperson said.

“No decision has been made in regard to construction sites.”

“As with all major transport infrastructure projects, Western Harbour Tunnel and Beaches Link will be subject to a rigorous and comprehensive environmental assessment process and extensive community consultation.”

Balmain Tigers have demonstrated their traditional fighting spirit, staving off voluntary administration by negotiating a significant financial contribution from Heworth Pty Ltd, the developer who took control of their Rozelle site 18 months ago.

Rumours have swirled for days that Balmain, a 1908 foundation club, would be forced into voluntary administration, almost 10 years to the day after the start of the global financial crisis, which halved the value of their assets.

Balmain's two licensed clubs, at Sydney Markets and Five Dock, have not provided the cash flow necessary to meet all its obligations, but Heworth's executive director, Gary He, agreed to a rescue package.

“The new owner listened to us and gave us a substantial cash injection, which we will use to refresh the two small licensed clubs we operate, as well as maintain our quarter share of the Wests Tigers NRL club and service our junior league,” Balmain chairman Dr Leslie Glen said.

Balmain’s hold on their 25 per cent share of Wests Tigers depends on meeting a debt to the NRL by November 2021. Four years ago, the NRL advanced Wests Tigers $10 million with Wests and Balmain to repay $5 million each. Wests repaid their debt and took control of half of the debt of cash-strapped Balmain, reducing its debt was $2.5 million.

However, an interest rate of 4 per cent has seen it grow to $2.8 million and it is expected to be $3 million by the sunset clause.

The NRL will own the 25 per cent if Balmain default, but the governing body is expected to offer it to Wests Leagues Club at Ashfield, which now owns 75 per cent.

Wests' preference is for Balmain to pay the debt by the settlement date. After all, the NRL will insist the club forever be badged Wests Tigers, the only name a generation of young fans has known and the Tigers heritage carries sponsorship opportunities.

“Our DNA must be in there," Dr Glen said. "We fought to survive for the heritage we have. We’re going to have the quarter share forever. We’ve also got 3000 kids in our junior league.

“I’m very grateful to all those who’ve helped – the new developer, Wests Ashfield, Inner West Council mayor Darcy Byrne.”

While Heworth Pty Ltd's 11th-hour rescue package has staved off voluntary administration, it could be in the interests of the developer and Balmain to maintain their relationship. It is understood the height of any development at the Rozelle site is dependent on a future Balmain Leagues Club occupying a top storey. No Tigers licensed club and perhaps the site would be less profitable to the developer.

“There are implications coming from a Land and Environment Court judgement of August 2016, which guarantees the return of a Balmain Leagues Club to Rozelle,” Dr Glen said.

The clock may be ticking towards the NRL’s November 2021 sunset clause, but 10 years after the GFC, Balmain are still in a fight for survival.

I call bullshit. The guy is a billionaire. If the stock market goes up 10% he earns 100 million dollars. I earned 10% last year by doing nothing. I assume he made at least that return.

If he is a fan he is a very cheap fan. I'm cheap too but I'm not a billionaire.

I think we would all like him to help, but as I understand it, we shit on him, so cant blame him, if true.
