Either that, or eleven jurors went one way and Pou was the 12th juror.

Hayne looks enormous. He’s in no shape to be considering an NRL return. He’d need to spend the next 2-3 months dropping weight, which leaves very little time for anything else.

NRL star Jarryd Hayne 'wouldn't have raped a woman as her mum was watching TV in the next room' his lawyers claim

  • Lawyer told the court he would've known there was a risk of her screaming out

Former NRL star Jarryd Hayne would not have forced himself on a woman, knowing her mother was only 10 metres away watching television, his rape trial has been told.

Defence barrister Phillip Boulten SC told the Newcastle District Court jury Hayne would have known there was a risk of the woman screaming out.

Hayne's actions on the night of September 30, 2018, while the mother was watching the NRL grand final on TV, did not show he was 'hellbent on sex at all costs', Mr Boulten said in his closing address on Wednesday.

When the complainant became angry after realising Hayne had a taxi waiting outside her house on Newcastle's outskirts and allegedly told him she wasn't going to have sex with him, Mr Boulten said this did not mean she was 'putting down the shutters on friendship and intimacy'.

He told the court that when Hayne later leaned in a for a kiss on the bed, the woman kissed him back and they moved on to the next stage of intimacy when he performed oral sex.

She suffered two lacerations to her vagina which Hayne said must have been accidentally caused by his finger.

In his closing address, crown prosecutor Brian Costello told the jury not to have any sympathy for the famous footballer.

Crown prosecutor Brian Costello told the jury they have no discretion to give Hayne (pictured with girlfriend Amellia Bonnici) 'a pass' and find him not guilty of rape because of who he is or the fame he has achieved

Mr Costello told the jurors they have no discretion to give Hayne 'a pass' and find him not guilty of rape because of who he is or the fame he has achieved.

The prosecutor said Hayne had left a group of his footy mates watching the grand final for one reason - to have sex with a woman he had never met.

He told the court Hayne believed he had been promised sex after exchanging flirty messages on social media with her.

Mr Costello said the only thing that stopped the sexual activity was her injuries because Hayne had been so rough.

Once the woman was injured Hayne couldn't get out of the house quickly enough, Mr Costello claimed.

Jarryd Hayne leaves court after trial over rape accusations

'The accused's state of mind when this all happened was a guilty one,' he said.

Hayne had paid a taxi driver $550 to take him home to Sydney after a two-day bucks party for rugby league player Kevin Naiqama in Newcastle when he decided to pop in to the woman's home.

The woman, now aged 28, allegedly later sent text messages to a girlfriend saying she thought Hayne had bitten her vagina and she felt violated after telling Hayne 'no' and 'stop'.

Hayne, 32, has pleaded not guilty to two charges of aggravated sexual assault inflicting actual bodily harm.

Mr Boulten is expected to finish his closing submissions on Thursday, before the jury is given directions and retires to consider its verdict.
