Firstly, using a solicitor who doesn't specialise is very dangerous, as Hadley and 2GB will have the top barristers AND the top firms stitched up. The solicitor still plays a very important role.
But the point I was really making is that this is nowhere near being litigation yet. it is really Murphy promoting the "litigation" (and himself) at this stage. Very bizzare because if you are really concerned about bad publicity, suing for defamation just rehashes the whole incident. Murphy is effectively starting a separate little media fight about the conflict between the two. There's no real basis to say he has been instructed yet. And they can't issue proceedings until they issue a concerns notice complying with the Defamation Act anyway - and there's no suggestion that has been done yet.
