GRAND finalists Sydney Roosters have threatened to sue the National Rugby League over the salary cap, arguing that it breaches national competition laws.

In a letter sent to the NRL two weeks ago and obtained by The Sunday Telegraph, lawyers acting for the Roosters say the team will be forced to take legal action in the Federal Court if the NRL fails to increase the salary cap for 2005.

limits how much clubs can pay their top 25 players.

It is championed by the NRL as a means of providing a better competition by ensuring less successful clubs are able to hire top-drawer players.

The letter, drafted by Sydney law firm Teakle Ormsby Conn, was prompted by a decision not to increase the cap in 2005. It was sent to NRL chief executive David Gallop on December 11.

"We have formed the view that the Sydney Roosters have a cause of action under Section 45 and Section 46 of the Trade Practices Act, together with a common law action for restraint of trade," the letter says.

"We are instructed that over the past few months, you have indicated to our chairman (Nick Politis) that there will be an increase in the salary cap for the 2005 playing season.

"Now, it appears there will be no increase in 2005, therefore the NRL leaves the Sydney Roosters with no choice than to commence legal action in the Federal Court of Australia in early 2004."

Sections 45 and 46 of the Trade Practices Act cover contracts that restrict competition and the misuse of market power.

Mr Gallop told The Sunday Telegraph yesterday the NRL would defend any action, calling the salary cap "the foundation stone of the game's success".

"We've just had the best season ever, and I'd be surprised if one of our clubs is seriously suggesting we do away with the cap," he said.

"We haven't made a final decision on an increase, but the indications from 14 of the 15 clubs at the annual conference a few weeks ago was that the game couldn't afford it."

Newcastle Knights chairman Michael Hill said he was stunned by the Roosters' threat.

"I'm amazed, because I don't think the issue of there being no increase has been fully resolved," Mr Hill said.

Sources said there was a real possibility the cap could be found to be illegal, forcing the NRL to abandon it.

Peter Fitzgerald talks some sense for once, remember that the Eels are one of the wealthy clubs:

"I think it is absolute madness on the part of the Roosters," Fitzgerald said. "It just demonstrates their total arrogance and the fact that once again, all they are concerned about is looking after their own vested interests rather than what is good for the game.

"What they are essentially doing is attempting to hold a gun to the head of the NRL." /ends

Aren't NRL licenses up after 2004? Would it be so hard to just not invite the Roosters to come back and play?

I mean hey, if they don't want to play by the rules, then they can go and get f**ked as far as I'm concerned.

Maybe the Goosters are afraid about 2005 with that HUGE contract they signed that Souths turncoat to.
What was it. $50,000 a season until 2005 then about $450,000 for the last year???

I support two teams - The Sharks and any team who plays the Roosters !!

I live right near the SFS and i go to Roosters games just to support the other team.....

They own most of the kids from Endeavour High, that was a disturbing snapshot when someone posted their clubs, but I fear it would be just the tip of the iceberg.

This is shocking. If they destroy the salary cap then the fabric of league will be out the window forever. It will be an English premier league system with a big 5 (including a super 2 or 3) and then the rest will struggle to catch the top teams.

That's putting aside the fact that the code may not even survive. There may be 3 teams, Roosters Bulldogs and Parramatta - and tell me how is that good for anyone?

This is disgusting. A team that does SFA for development is now whingeing that they should have enough money to poach everyone else's players AND hold on to their 13-odd representative players. It's short sighted, it's arrogant, it goes against the egalitarian way of this country and it's typical of the Roosters. I hope they get thrown out.

That also poses the question: Can the smaller clubs take the Chooks to the ACCC to complain about anti-competitive practices?

Is this a bit Orwellian or what?

Yes sports fans, it's the 2010 NRL Grand Final. It's Gus' Goosters -v- Ricky's Rorters, the game that the whole 27 fans have been waiting for.

Then for encore Gus could could pick his NSW side, which would be very similar to the above 34 players!!!

Then the Australian Team coached by Ricky could then be selected from the victorious or losing NSW side. It won't matter because there will be no opposition in this country.

That's my spit.

That's how I see it too, Coastal. Or maybe they could break away and form their own comp, a la Super League or AFC. Then they could play with themselves and everybody else could play in the NRL. It's just like the newspapers said (paul Kent, I think). They want to pick the flowers but they don't want to plant the seeds.

Super League had a vision for the future.

This is the most short sighted idea I have ever heard of. After a few years it will be 3 or 4 clubs playing each 1 or 2 games per weekend. The Roosters players might get 2 years of extreme salaries but what about when all the other clubs die and they dont have anyone else to play? Then uneducated assholes like Justin Hodges and Michael Crocker can get back in the gutter where they belong, shoveling shit on a farm or seeing drunks in and out of some lower class pub as a security guard.

There maybe a way around this, we remember when Rupert tipped in hundreds of millions of dollars for super league, with the roosters wanting increase in salery to 3.5, and even 4 million, get Rupert to sponser the other teams for another 1.75mil, making the rest of the teams have 5 milllion, the league then sets the cap at 5mil, and in couple of seasons, the roosters cant compete , there booted and cap reduced to 3.25 mil, goodbye roosters
