Actually, the two have different levels of "burden of proof". The civil burden of proof (more likely than not) is considered lower than the criminal burden of proof (beyond reasonable doubt).which would have relied on his guilty verdict in a criminal proceedings court
don't think they have much of an argument now
So the civil proceedings are not reliant on a criminal guilty finding at all. Hayne's civil payout in the US is a case in point - no criminal charge/guilty verdict in sight.
