It will be interesting to see if the Roosters end up having to compensate the Tigers for any lost revenue as a result of this debacle...

WESTS Tigers are furious over a last-ditch approach and alleged bargain-basement offer from the Sydney Roosters that threatens to derail their potential new sponsorship deal with car manufacturer Proton.
The Tigers are hoping to hear from the Malaysian-based company as early as today on which club it will opt for and it is believed the deal could go either way.
The Tigers are particularly disappointed with the actions of Roosters chief executive Steve Noyce, who played a major role as the former boss of Wests Tigers in luring Proton to the joint-venture club in 2006.
The Roosters are desperate to find a new sponsor and generate some positive publicity after major backer Samsung pulled the pin on its six-year association with the club from Sydney's eastern suburbs over a string of damaging headlines this season.
The Australian was told yesterday the Roosters' offer undercut the Tigers' bid by at least $200,000 and could include other contra in the form of possible advertising to help promote Proton's new model.
Tigers chief executive Stephen Humphreys did not want to go into any detail when contacted by The Australian yesterday but said he was still hopeful the car manufacturer would continue its four-year association with his club. Humphreys said he intended to contact Noyce soon to discuss the matter and he would also raise it when he visited NRL headquarters today over another issue.
"We're very close to re-signing Proton and we've been working on that with the good people from Proton in recent weeks," Humphreys said.
"I am aware of a last-minute proposal from the Roosters which has been made on very attractive terms."
Noyce declined to go into details of the Roosters' offer but said he was shocked at any suggestions he had done something underhanded to sway Proton's decision.
"I've spoken to the guys at Wests Tigers and explained the situation," Noyce said.
"Obviously Proton consider there may be some opportunities for them to link with the Roosters and my job if we don't have a major sponsor is to get proposals out to potential clients to create win-win partnerships.
"Samsung were after brand awareness when they were on the sponsorship trail and they to their credit and with the Roosters and other people's help have now got great brand awareness.
"I'm a bit shocked to think anyone would ever think I'd do anything underhanded."
It is believed Samsung flagged its intentions to withdraw its corporate support some time ago and there was speculation the Roosters then approached Proton in a bid to sign them up and minimise the negative publicity over losing a major sponsor.
The Tigers have a reputation as a relatively cleanskin club under the watchful eye of veteran Test coach Tim Sheens and to counter this obstacle it is believed the Roosters offered Proton a much cheaper deal to sweeten the pot.
The Tigers are bitterly disappointed given they had been working hard on a deal with Proton which, like other major companies, was re-evaluating its position on sponsorships as it continued to battle the effects of the global financial crisis.
However, it is understood a positive upturn in sales in the last few months and the Tigers' impressive end to the season - they finished ninth and just missed out on a spot in the finals - saw the company keen to continue its association.
Noyce told The Australian on Sunday he was confident of landing a new sponsor before the club's opening game of the season against South Sydney in March but he would not slash the price of the jumper in the process.
He said the club was using new coach Brian Smith - a strict disciplinarian with a reputation for rebuilding clubs and restoring their image - as a selling point.

Unfortunately it is 'dog eat dog' out there in corporate world and yes, Noyce retains corporate knowledge of WT goings on- at least up to the time he left. If the sponsorship contract is up - we can only put in a bid.

WT pluses are many- we have a good image, community relations and useful demographics. If Proton want to go elsewhere, then we have to shop ourselves to obtain another sponsor. The only hassle is that it would have been easy to extend Proton. If Proton want to go to the badboys (and I hope they dont) we will find someone else.

Except for the equitable principles concerning confidential information... Humphries would want to take himself off the the Supreme Court for an injunction, pronto!

Dont disagree but hard proving it once a contract / sponsorship is ended and up for re-negotiation. I hope it ends up well for WT. Very disruptive at this stage of events. Ha ha, I was thinking the same thing... and yeah, those would be the essential arguments. There is plenty of legal precedent that says how and when information is confidential, and I can't see how Noyce could argue that his prior involvement in sensitive high-end discussions with Proton on behalf of WT could not have played some part in his ability to offer them a more attractive deal elsewhere as soon as their contract was up. It's pretty much textbook stuff... Now it is up to Humphries to figure out what he wants to do about it... Going for an injunction may not be sensible if it means spooking Proton - but putting in a claim for damages against the Roosters after the fact could be extremely rewarding.

I'd love WT to do anything possible to stir the Roosters up. Dont hate them but sure dont hold them with any regard- buy players, little or no juniors, only exist because they can afford to buy players instead of developing them.

Using contacts is one thing - depending on the nature of your employment contract and what restrictions you might be under when you cease employment. But utilising information that you obtained in confidence while in that employment is an issue. Noyce would have intimate knowledge of the deal between Proton and the Tigers and is in a unique position to undermine their continued relationship. The contract is up for renew, so any deal is up for grabs... But how many NRL CEO's are going to know which buttons to press in order to get that deal? The incumbent, and the guy who knows the incumbent's secrets.

IF Proton did sign on with the Roosters would the NRL allow the sponsorship anyway seeing as Toyota is a major sponsor of the NRL? I'm under the understanding that Proton was able to be our sponsor due to the fact that our deal was done before Toyota jumped on board.

If they did it to the Bulldogs with Strathfield Car Radio, they surely would have to do the same with any Roosters/Proton deal.

Sure, but it's a big assumption that Noyce even had to use the secrets. What if he just spoke to the head of marketing and things went from there? No doubt it's a scummy and immoral act. I would just have reservations as to whether or not it was a breach of confidence. Possessing confidential information and using that information at the expense of the confidant are two very different things.

It doesn't matter what his intentions were, or whether he thought he was doing a deal without having to rely on his prior knowledge of an existing agreement. The fact that he's privy to sensitive information means he's crossing a line by even talking to Proton without first getting the OK from his previous employer. Evidently, he hasn't. The issue is not whether he's breached confidence, it is whether Proton would have signed with the Tigers again or not if Noyce hadn't come in with a carrot. That's what will be difficult to prove - but not impossible at the civil standard of proof if indeed it is the case...

proton shouldnt be allowed to enter in a new deal with anybody else because the NRL most likely have an exclusivity deal with toyota (same as any other side apart from auckland cant have a deal with a phone company)

It is the U20's that have exclusivity with Toyota hence the naming rights of the Toyota Cup and this doesn't extend to the Top Tier competition.

Both NZ and Melbourne have been sponsored by Suzuki so there is no issue with vehicle manufacturers sponsoring an NRL team.

I know that the Wests Tigers are 95% signed with Proton again but the deal has changed considerably and the outcome will be something that I haven't seen in the NRL before and it will increase the overall $$$'s that we receive for our jersey sponsorship.

I know the WT marketing department cop a bit of flack from time to time but in my opinion they do a great job and this deal that is nearly done is another example of there ability to think outside of the square.

Watch this space!!
