After the bad publicity caused by the ridiculous exoneration of Thurston for his verbal tirade against referees, you would think that the NRL would want their men in the middle, or at the very least the judiciary, to be seen to be taking action the next time a player pipes up with disgraceful abuse towards the referees.

Seems the message hasn't gotten through.

CRONULLA'S 2011 captain Paul Gallen has escaped punishment despite calling referee Jared Maxwell a "f ... ing cheat" during last weekend's match against Manly.

The Daily Telegraph can reveal Gallen clashed with Maxwell in the 31st minute with the Sharks being belted 26-0 at Toyota Stadium.

Gallen was penalised and cautioned by Maxwell - but not sin-binned or sent off.

Failure to dismiss Gallen has set an ugly precedent for referees at all levels of rugby league. NRL refereeing officials were furious that Maxwell failed to dismiss Gallen with the drama being discussed at the weekly refereeing debrief on Monday morning.

A shocked Maxwell told Gallen on the field: "Now, I respect your frustration, that's the first point.

"The second point, there is no way in the wide world I'm going to talk to you the way that you just talked to me, that's why you're going to get a penalty [be penalised]."

The NRL match review committee did not issue a charge against Gallen because his words were inaudible on the Fox Sports coverage, but Maxwell knew exactly what the Sharks star said.

With no audio back-up, the review committee felt an on-field penalty was sufficient.

That means Gallen will not be fined, suspended and reprimanded, and he'll be free to play in Cronulla's match against Canberra on Saturday afternoon at Canberra Stadium.

Maxwell will not referee this weekend although NRL referees coach Robert Finch insisted last night he was not sacked but "rested".

Manly players were stunned to hear Gallen's accusation and then see him remain on the field.

At least four times during his record-breaking career, former leading referee Bill Harrigan sent players from the field for dissent.

There were suggestions that fans wearing Sports Ears at Toyota Stadium could hear Gallen's harsh words.

The drama comes a day after new Sharks coach Shane Flanagan confirmed Gallen would lead his club in 2011. NSW management will also consider Gallen as Blues skipper for next season.

Finch would not name Gallen as the offender, only saying: "All I will say is that the referee spoke to the player and our review found that harsher action needed to be taken." Neither Flanagan nor Gallen would comment about the foul language last night.

NRL chief operating officer Graham Annesley said: "Any incidents that take place on the field are under the direct control of the match officials in the first instance.

"But, of course, they are able to be reviewed by the NRL match review committee. If there are no charges as a result, the matter ends at that point."

Junior rugby league referees are strongly encouraged to dismiss a player for dissent.

Absolutely disgraceful from all involved. Gallen should have been sent from the field immediately, and he should be facing some sort of sanction.

Paul Gallen is an absolute disgrace, but Maxwell isn't far behind for being such a weak, lily-livered excuse for a human. And the match review committee and judiciary are the same.

Looks like it's open season on refs, a great example to set to junior players no doubt.

He's a f**king incompetent prick, but he's probably not a f**king cheat. Gal was half right.

Gallen is a blight on the game at times.

A bit of a Koala as well in regard to sanctions for some of his on field exchanges as well

Gallen should of been banned for life years ago. Why the f*ck can't a low life like him piss off to yawnion/afl??

A local captain-coach here was fined $500 for saying in the paper that the refereeing in a game was "the worst he'd seen in 15 years" and that "there were bad decisions for both sides". And this is not a bloke being paid half a mil a year. Pretty tough I reckon. Yet these blokes can say almost anything and get away with it.

It's not really the sort of attitude you want from a captain either is it? Blaming the referee for being down 26-0.... and conceeding a penalty whilst in posession too.

If that is what Gallen said, then there's no doubt whatsoever he should have sent off. They're getting themselves into a real tangle here, firstly they allowed Thurston to carry on like he did due to Origin commitments in all probability, and now this comes off the back of that.

This is inconsisten, Thurston was cited and had to front the judiciary, surely Gallen as a minimum would have to face the same, if not a harsher, charge.

Gallen is an Origin palyer and has represented Australia, he was acting skipper tha nite and in the heat of battle swore at a ref..he is entitled to address a referee and query the many contentious decisons that were going Manly's way.
Gal gives 100%, he is no slacker, you would rather he be upset thatn turn it up like othre clubs players do!

well thurston thing was different, firstly he swore whilst talking to the ref, not at the ref, secondly whilst he did say he should be man on the match he didnt call him a cheat, andf thirdly thurston was facing a 1 week ban which would have been fine with him to play origin still.

but the point remains that theres a problem where players are abusive and aggressive towards the refs. i dont want to see it like soccer where the players chase the ref around the field. Last week Burgess was warned for running at the ref and i think a dragons player was warned about it too. but until the refs have the balls to send someone off or bin them the players will keep doing it

JT set a very bad precedent for this kind of thing. Since Thurston didn't get sent off, Gal didn't. If the referee had sent him off, there would've been an uproar by Sharks supporters (like Phil Rothfield) as to why Gal was binned but Thurston wasn't. If he doesn't sent him off, he'll be called weak. There's no way he could win in that situation.

As for juniors, at least here in Newcastle, the rules have been updated so that if you swear at a referee you get a three week suspension and a second offence will get you deregistered. Gal swearing at a ref is hardly going to make a kid want to risk a punishment that severe.

Typical that this artical only makes the papers because its gallen. Listening to sports ears every week you hear the ref being called f**king cheats etc. Gallen does it once and its in the papers
