There’s the difference though. If the defender is not sure whether it was taken in the field of play, then there would have to be an element of doubt. I.e the ball was taken close to the goal line.
Oates caught the ball 3 metres inside the in goal area, and ran back into the field of play from between the posts.
Tackling a player in that circumstance is clearly a professional foul. The first example is not.
Most players are, marginally, less bone headed than Samuela Fainu. I’d wager the only chance of this happening again would be, as you say, when there is doubt over where the ball was taken. Which would not be a professional foul, so no sin bin.
