Storm papers should be available: judge

A judge said he would be "staggered" if the NRL could not quickly produce key documents relating to salary cap penalties imposed on the Melbourne Storm.

The Storm are seeking a Victorian Supreme Court injunction to restrain the NRL from imposing salary cap breach penalties, which included stripping the club of their 2007 and 2009 premiership and preventing them earning competition points this season.

They argue the penalties announced on April 21 are in breach of NRL rules and the decision-making process in imposing them was not fair.

The case returned to court on Wednesday as the parties prepare for a likely August hearing.

NRL barrister Michael Colbran told the court he needed time to locate documents requested by the Storm about the decision-making process surrounding the penalties.

Justice Tony Pagone said most of the documents should be at "the fingertips" of the NRL.

He said he would be "staggered" given the recent investigation, if the documents were not readily available.

Storm barrister Pat Zappia said the club wanted access to documents detailing the timing of the press conference to announce the penalties.

He said the timing could represent evidence of pre-judgment of the penalty.

Justice Pagone urged the parties to quickly prepare their cases or risk missing the August hearing date.

"There are people knocking on the door who want this date," he said.

An August hearing would likely see the matter resolved before the NRL finals series which begins on September 10.

The matter will return to court for a further case conference on June 17.

Normal legal procedure allows for up to 14 days to produce documents which are deemed easily accessed.

Talk about an over reaction from desperate fans looking to hold onto some modicum of thought that their club has been hardly done by.

FTR the documentation of minutes of the meeting relating to timing of the press conference do not relate to the investigation persay so would not be the first document at the top of the files on this matter.

But carry on with your victim mentality anyway

Victim mentality that your club has somehow been stitched up by a great conspiracy.

Nobody is doubting that the fans are the victim, the victim of their own clubs administration, Rob Moodie included it may seem

No, the rest of the code and the codes fans are victims as well.

Direct your anger at your own club who created the mess (like the rest of us), not at the NRL who had to act.

Agitate to vote your Board of Directors out at the next opportunity. Think about the reasons they are launching legal action, could one of them be to "look good" amongst the membership base and ensure their own re-election?

As for the prompt "delivery" of the documents, they are the opponents of the NRL and News in this matter, do you honestly think that News and the NRL are going to make this nice and smooth?
f**k no, they will want this sh*t to be an absolute headf**k for whichever clown arse bargain basement hack ends up taking the case on after the 4 independent directors waste all their money on a good SC and then can't afford to have him finish the job off.

Good point, I guess the NRL would like to drag it out as long as they can.

How many years of rorting did it take before the Storm unearthed their 'documents'? They can go get f**ked.

Perhaps mate, long or short proceedings withstanding, they'd want it dusted either well before the finals, or after them.
In any case it would be good to have this sh*t sorted by next year, but in defence of the NRL the storm players are not exactly being co-operative therefore making it impossible to determine a final amount which must be trimmed from the cap.

Its not ideal, this sh*t dragging out, but when you have 4 dickheads pulling this sh*t on and you can't take out contracts on their life, you need to reply in kind, and that reply is dredging the sh*t out and making it as expensive as hell to try and achieve hoping that people will stop giving a sh*t or run out of money.
Hell, some mining companies have made an art form out of this practice.
