And since when would the cops come and say 'We're also levelling a lesser charge in case the other one can't be proven beyond reasonable doubt'. If it goes to trial, the jury will hear what the charges are.

If they are going to leak stories to the media (especially in high profile matters) it is already pretty grubby, there really should be an obligation on the police and prosecution to be open and honest. Not leaving an impression that an accused is facing a charge out of a new incident. It is a pretty basic expectation that the police have high integrity.

It's not ideal, but I don't have a big problem with them tipping off a change in the charge sheet 12 hours ahead of schedule (assuming they did it in the first place). I am concerned however by the reference in the article to the fact that:

Who cares if the alleged victim was known to police....that statement is more likely to cause prejudice.

It is probably going to be a case where people/jury are going to have to decide who to believe based on not very much. So if she is a dubious character it is relevant and there is nothing can be done about the jury already knowing about Haynes character which is a google search away.

Jarryd Hayne will reportedly today be served with a second charge relating to an alleged incident of sexual assault of a Newcastle woman in September last year.

Fairfax reports that the new charge — sexual intercourse without consent — is in relation to the same incident for which Hayne was last year charged with aggravated sexual assault inflicting actual bodily harm.

The double Dally M medallist pleaded not guilty to original charge levelled in November last year, and is set to appear in Newcastle Local Court on Wednesday.

The alleged incident occurred on NRL Grand Final night, when an intoxicated Hayne allegedly travelled to the 26-year-old woman’s house north of Newcastle after the pair had been communicating on social media.

Hayne then allegedly sexually assaulted the woman, taking off her clothes and biting her genitals. The woman attended hospital for treatment on those injuries the next day, with it alleged Hayne drew blood with the bite.

The Sydney Morning Herald reports that the new charge relates to a ‘specific sex act’ Hayne allegedly committed on the same night.

In a brief court appearance in December last year, Hayne’s lawyer Leo Premutico said the former Parramatta Eels fullback “maintains his innocence and maintains he will be pleading not guilty”.

“He’d like at this time to thank those who have offered him support, in particular his parents, his mother and father” Premutico told the court.

The Eels had shown interest in re-signing Hayne under their limited salary cap at the end of last season, but backed away from the star after the original charges were levelled late last year. St George Illawarra also indicated interest in the star before the charges, then offered a new deal to Matt Dufty to shore up their fullback stocks.

No so much in criminal matters....I honestly don't know mate. The conviction rate is not high, but the facts and evidence differ from case to case.

My mate who did his law reckons its very hard to prove. Also reckons there was a lot of rape cases that would come in and many seemed more like a girl unsure if she was raped or not but just used.
What a fall from grace.

If you're referring to the special one here, how was she used? By hooking up for a 1 night stand with a total stranger via a social media platform?

If he is found not guilty I would give him a lifeline. He doesn’t deserve to go out like this. Not a player that would make the greatest Eels side of all time.
