Albert Bertini … fall out with joint venture partner Crowe.

THE fortunes of the flamboyant property developer Albert Bertini, in his joint venture with the South Sydney football club owners Russell Crowe and Peter Holmes a Court, have come crashing down following the appointment of a receiver.

The National Australia Bank moved earlier this month to appoint insolvency firm KordaMentha as receiver. It is the final chapter of the redevelopment saga, which was delayed by years and saw a falling out between Mr Bertini and Mr Crowe.

A KordaMentha partner, David Winterbottom, said late yesterday that he would seek tenants for the remaining vacant space in the Chalmers Street headquarters of the Rabbitohs, and then ''there will be a sale process''.

The National Australia Bank holds a mortgage debenture over the joint venture company that developed the Redfern site - dubbed Souths on Chalmers - which also gives it access to any cash and other assets of the joint venture that would not be covered by a mortgage.

The company, which houses the joint venture High Concept Commercial Pty Ltd, comprised a 50 per cent stake by Mr Bertini's company, Trivest Pty Ltd, with the remaining 50 per cent held by Mr Crowe, Mr Holmes a Court, and a minority stake by members of the football club.

Late yesterday, the chairman of South Sydney Football Club, Nick Pappas, said neither the members nor Mr Holmes a Court and Mr Crowe had any exposure to the bank.

''[Trivest] procured funding for the venture from the NAB, it is a non-recourse against the club,'' he said. ''This is a story of a developer who goes into a joint venture, assumes all the risk and management, and unfortunately goes through hard times, but thankfully completes the building in large part.''

Officials from the South Sydney Leagues Club did not return calls from the Herald.

Mr Bertini's business has been the subject of speculation since he relocated to France late last year, selling his Mosman mansion and several other properties. While he had paid a record $22.5 million for the house, it sold for $18.5 million in December.

Trivest, which at its peak was reported to be worth $400 million, has been unable to finish a number of projects including Souths. Yesterday, phone calls to Trivest's offices during business hours went unanswered.

Trivest aren't the only ones in trouble. I hear that Souths on Chalmers is insolvent. Crowe, Bertini and HaC have a lot to answer for.

I've been given a tip that at an emergency board meeting tomorrow Richo, Tallis and Wrigley may be punted. Nothing untoward other than Maximus is none too happy with the way the club has been performing. My source was on the money about GI early in the year, so keep an eye out for action on the top floor in Chalmers St.

SOUTH SYDNEY Leagues Club owes more than $1 million to tradesmen for work completed on its refurbished Redfern premises.
Its chairman, Bill Alexiou-Hucker, met private financiers on Thursday to try to obtain funds so it could meet the overdue payments to contractors who worked on the fit-out of the club. He said the club's day-to-day revenue was healthy but confirmed it was seeking an injection of funds to secure its finances.
An independent adjudicator, who has the legal power to deal with disputes between contractors and clients, ruled last week that All Tech Electrics Pty Ltd was owed $410,340.29 for part of an electrical fit-out contract. The adjudicator gave the club five days to pay.

The district court could order a sheriff to seize property at the club or issue a garnishee notice for the claimant to obtain funds from the club's bank account if it does not pay by Tuesday's deadline.
In his determination of the claim, the adjudicator, Thomas Uher, ruled: ''The respondent [the club] does not dispute that the claimant is entitled to payment of the claimed amount. The only reason for denying payment to the claimant seems to be the respondent's lack of funds.''
A director of All Tech, Sam Scarfo, said he knew of two other contractors owed money. He said the total amount outstanding from the club was more than $1 million, which Mr Alexiou-Hucker did not dispute. ''They contracted me to do the fit-out and they can't pay me,'' Mr Scarfo said. ''It's going to send me under if I don't get my money.''
The adjudication comes after it emerged High Concept Commercial Pty Ltd, the property company that developed the building in Chalmers Street, Redfern, in which the South Sydney Leagues is based, had gone into receivership. The building is also home to the Rabbitohs football club.
The property company was a joint venture, half-owned by the developer Albert Bertini. The other half is owned by the actor Russell Crowe, Peter Holmes a Court and a minority stake by Rabbitohs members.
Mr Bertini, speaking in Sydney last week, accepted he had lost a substantial amount of money as a result of the site's redevelopment but the investment was not connected to his other development company, Trivest Group. He said he had not fallen out with Mr Crowe but he had - ''100 per cent'' - with Mr Holmes a Court.
Mr Alexiou-Hucker, asked if he was embarrassed, said: ''I wake up [at night] but also our CEO, Ken Stewart, he doesn't sleep. I go to bed every night with a knot in my stomach. I feel terrible.'' He said he did not believe the sheriff would come knocking.
''I don't want members to think come Tuesday they will be arriving to a club without any furniture because we are very close to doing a deal with a funder, which I think will get this out of the way. Then we can concentrate on Souths on Chalmers [the club's new name] as the vibrant place that we always had a vision for it to be.''

Tell that to the workers who are owed cold hard cash in the vicinity of $1m. I know one of them is a Souths fan who is heart broken by the way they've been treated. But then again, it's nothing to do with Souths is it?

That's obviously not what I meant. I meant in terms of risk and debt and bankruptcy.

Of course it's sad when anyone loses their job but it happens. In this economy it's not an isolated incident.

In terms of employing people, the Football club is now employing many more people than it did pre 2006. That's a lot of people with jobs that wouldn't have had them if Souths went bankrupt in 2006 like it could have if it wasn't for Crowe.

People didn't lose jobs. They did them. And then when they asked for payment they were told there is no money. If you try and get something from a shop without paying, it's called theft. If you receive services without paying for them it can be called fraud.

The debt isn't on the football club. So the blame isn't on the football club. The blame is on Bertini.

The original plan was for the LC to sell to Hac and Crowe and they would have their debts paid space in the club and a museum etc plus cash in the bank. The LC owes plenty from earlier debt and is not trading all that well and it is a tough time for all clubs.
The money Crowe and Hac put in up front went int the football account which was about 3.7 million approx and the football club is not recording the profits they claim according to their annual reports. But getting back to the High Concept issue it means when all is said and done the assets it once had will be gone which yes where the LC not the FC but it seems to have been pissed away and trivets was only a 50% shareholder and the peoples hero and his mate the other, you can't put all the blame on Bertini.

If I was a Souths fan I wouldn't take sides on this. Pappas, Crowe, HaC, Bertini, Alexiou-Hucker, Richardson, Hatfield... they're all to blame. I'd be outraged at how this mob has tried to drag the Souths name down.

Further to media commentary and speculation over the past few days, regarding the receivership of High Concept, the Board and Management of Souths on Chalmers feel it important to make The Club's current position clear for all members and other interested parties:

Souths on Chalmers has ownership title, to 1500 square metres of the 265 Chalmers Street building, which is the floorspace our new Club occupies.

The receivership of High Concept does not affect in any way our ownership of this space and nor does it affect Souths on Chalmers trading.

The receivership only means that there will in due course, be a different owner of the building, nothing else.

We at Souths on Chalmers believe that the appointment of a receiver is a positive step for the tenants of the building.

Due to the lack of progress of building works by Trivest, the Board of Souths on Chalmers cut all contractual obligations with Trivest in September 2011. This allowed Souths on Chalmers to find a new builder to complete the project.

If you think that "this mob has tried to drag the Souths name down" then you know nothing.
