Yes. Teams can't use incidents which didn't receive a charge as evidence - which is stupid. It's their way of saying that teams can't use their inconsistency against them.

I think maybe they want to take the appeal and its accompanying media circus out of the equation. There is absolutely no possibility he gets this downgraded two grades, especially after Cam Murray failed to get a downgrade for a very similar shoulder to the head just a few weeks back.
