Take Fafita out of the equation for a second. Look at where this story started from. That is a real concern. Forget about the fact that Fafita visits an inmate & the law that they are using, is not even applicable in this instance. Very knowledgable person I spoke to last night, said it would not last 2 seconds in a court as it cannot be applied in this situation. The fact it is only a warning, means that it cant be tested.
But think about how this became a story. Again, we have people in the force leaking information to the papers in order to derail the Sharks. Then we have the footage of the letters ready to go to print, & an assumed meaning linking them altogether.
Then we have the hysteria that has followed by enemies outside & within.
its a real worry that we dont circle our wagons as a club & hunt these cretins down & stop it.
Fafita has done nothing wrong.. End of story.
That is incorrect. The legislation is pretty clear:
93X Consorting
(1) A
person who:
(a)
habitually consorts with convicted offenders, and
(b) consorts with those convicted offenders after having been given an
official warning in relation to each of those convicted offenders,
is guilty of an offence.
Maximum penalty: Imprisonment for 3 years, or a fine of 150 penalty units, or both.
(2) A
person does not
"habitually consort" with convicted offenders unless:
(a) the
person consorts with at least 2 convicted offenders (whether on the same or separate occasions), and
(b) the
person consorts with each convicted offender on at least 2 occasions.
(3) An "
Official warning" is a warning given by a police
officer (orally or in writing) that:
(a) a convicted offender is a convicted offender, and
(b) consorting with a convicted offender is an offence.
The warning given is a pre-requisite before an offence can be committed. While the law was probably not brought in specifically to deal with visiting crims in gaol, I can't see a reason why it can't be used for that purpose.
I'm curious who the other convicted offender is, but given it's probably not someone as high profile as Kieran Loveridge I guess we haven't heard anything about him/her.
It is disappointing these days that supposed public outrage determines the extent of the penalty imposed.
Onus will be on Fifita to bounceback, we need him firing in every game if we're any chance of taking out the big one.
