Can one of you smart young gents give me some idea of what the rules are about making someone redundant in NSW. I think most of u know i work for a media company slashing more staff than u can poke a stick at.

Colleague of mine got made redundant today. Premenant employee but works part time (3 days a week). There was no voluntary redundancies offered. This was a out of the blue tap on the shoulder. Apparently some people on 1yr contracts are also going. I used to work as a contractor and know most contracts have a we can boot you with 1 month notice thing.

But i am wondering if there are any rules about permies getting the ass? There was a "restructure" of management positions late last year, but this is not a case of the position going bye bye in a restructure, they purely wanna cut costs and as far as i can tell have targetted the cheap options to pay out.

Are you asking can they actually do it? The answer is yes. Technically the position is redundant and they can not fill it for like 12 months. The employee also can't go back into the same position forn12 months as well.

Yeah i guess i am asking can they do it and are there rules about the package they need to offer(ie x weeks pay or some such thing)

So if i see em hire another programmer within the next 12 months i can set off some alarm bells?

Depends on what award you come under etc.

But if the workers are under an EBA then there might be something in there. In addition, a union might come in to negotiate in some cases.

In terms of rehiring, there are cheeky ways to get away with it. Make a full time redundant but hire part time. Vice-versa, to an extent. Permanent to casual/contract, too. Change the Position Description so it's not the same position and thus isn't the job made redundant.

It can be done relatively easily.

From personal experince, they can change the job title , it's as little as that in the corporate world to re hire the same job

It tends to come from someone who has little knowledge of the work needed, but wants to be seen as having the ability to make sweeping change , certainly makes senior corporate life interesting

I would imagine you guys have your own award, not just using fairwork?

The fairwork is the minimum requirements they have to pay you. Most larger industries pay above minimum.

There are a whole bunch of tax breaks you get to for being redundant.

As others have said, they will get around the redundancy rules if they want to hire someone else.

Im a computer programmer ... we dont have awards, union, etc etc ... no f**ker cares about us

I think my colleague did ok ... as far as i can tell got about 10 or 11 weeks - i used the calculator on the page HJ posted and it said entitlement is 8 weeks

I do mostly java/javascript
