A friend of mine has bought herself a unit and wants it renovated. Seems like there are a lot of hoops to jump thru.Needing a solicitor to draft something up for bathroom and if works over 20k then the builder needs a certain type of insurance. Does anyone have any knowledge on this stuff and what is needed?

I wouldn't be getting a solicitor to draft up my bathroom that's for sure.

Though their probably cheaper than plumbers.

It's a simple pro-forma renovation By-Law. It consents to the proprietor of the lot to have access to the common property and thereafter provides the Owners Corporation with indemnities. It needs to be approved at an Extraordinary General Meeting.

Home Warranty Insurance is mandatory for building works over $20k.

@hindy111 these lawyers do strata by-laws in their sleep. Get a fixed price quote, including PEXA registration.

Are you able to split quotes. It seems all 4 of the contractors she has had quotes of can't provide the insurance needed. So if had one guy to one part and the other another does that work?
Also what's your opinion/view on any of these guys who don't have this insurance. I instantly think they are a bit on the rough/cheap side for some reason.

Yeah I can’t give you advice on that. I can say that there are plenty of small job builders who can’t get the insurance because you basically need to put up your house as collateral.


Your options are to keep the cost below $20,000.

You could operate as an owner builder as they are exempt. However, owner builders essentially provide their perosnal warranty to any purchaser within 6 years of completion of the job. So be very careful with your waterproofer.

What I am asking is if did 18k for bathroom then get a different guy for kitchen and ifferent for floor etc. So total.may hit 35k but each quote is under 20k does this get me around it? Or do the count the total?

I have gone through hell through the years with Home Owners Warranty. Yes, you are correct. I had to put my house up as collateral, just to get the insurance to even work. Even then, the Insurance underwriter came back with a limit of turnover I could have per annum. WTF!!! I was limited to $1 million turnover a year. Max job size I was limited to was $400 k's.

How in the f**k am I supposed to grow my business when an insurance company decides how much work I can do?
It is an absolutely disgraceful system.
Sure, I understand they are trying to weed out the dodgy builders, but it hasn't worked as the dodgey's just go and do work anyway.

I have a perfect HOW Insurance record and have only ever had one false unhappy customer. My work was perfect. He was an accountant (and screwed me big time at the end of the job). Cost me many 10's of thousands and it wasn't worth my while trying to chase it through legal avenues as he would have made sure it cost me much more fighting it. He was a complete arsehole.
I later found out that 2 years later, he then sold the place for $3 million more than he had paid to buy and renovate, yet he nearly sent my business broke by refusing to pay the final bill, which was pocket money to him.
So where is the protection for builders?

Home Owners Warranty Insurance is a f**king scam. If I'd done a dodgy job on this guys house and he claimed against me, I could have lost my house, yet, I did the perfect job, and I didn't get paid in the end.

I've just never understood how an insurance company can decide the annual turnover of a business, but this is how HOW works. There's also been so many other hoops I have had to climb through, just to be able to get the insurance to be able to work that I haven't even mentioned above.
The whole system almost made me leave the industry, yet I have fought my way through it.
In the end, I've only ended up earning wages.

4) If the same parties enter into two or more contracts to carry out work in stages, the contract price for the purposes of subsection (3) is taken to be the sum of the contract prices under each of the contracts.

Sorry to hear that. Sounds like a shit system where genuine people get f**ked over.

Yep. So many merkins across so many industries that benefit from being turds.

No different to the Storm (and now Panthers).

It might suck but I feel like there is value in being able to hold your head high.
