That still poses no advantage to the attacking team. In fact the penalty would be a disadvantage as the defending team gets 13 players in a set defence as opposed to a scrum which provides more room. I guess taking the two might be a benefit but only in a close game
I agree but it just looks so damn ugly as it is.

This actually happened in a game this year - I think it was Penrith vs Newcastle

Penrith kept dicking around when there was a scrum 10m out from their line newcastle feed. Wasted time like all hell - ref demanding they form the scrum - gave up and penalised them instead.

At the time I wondered if it was intentional so they could get their full defensive line set.
