Subpoenaed material due to the Court this morning.
Sorry if I’m a bit slow, but is this from the legal reports in the paper?

Maybe some legal eagles can help my knowledge here but what’s to stop Melbourne simply deleting emails in relation to Lomax that are incriminating?

What’s to stop them deleting messages and calls etc from phones? And suggesting the player manager and Lomax do the same?

This is a genuine question btw. It’s not like their offices have been raided and everything seized, they’ve had many days to align their story, removing anything that doesn’t support it.

For a case such as this, I imagine we are relying on what they supply us and I can’t imagine scum are going to incriminate themselves.

Is that how the process works? The courts warn just rely on the honesty of people being involved??

Surely it’s just a f**king waste of time as who would hand phone messages/emails to get them in big trouble?

Let’s not forget this is a club convicted of systematically rotting the cap, having 2 sets of books and players that were in on it. The whole club stinks.

You can't delete digital stuff these days. You can only remove from view.

If anyone is dumb enough to withhold evidence or tamper and risk being in contempt, then they deserve to go to jail. Worse, the law takes a very dim view of a company doing it.

Anyway, how do you know that they (the other side) don't have a copy of (or witness that knows about) what you deleted ?

If a party doesn't produce something, it is difficult to enforce unless you have prior knowledge that such document exists.

Yes, people can attempt to be "clever" and tailor the docs produced.

However, I have seen on many occasions where a long and tedious matter produces documents from other sources and/or communications that later show that the documents in question almost certainly existed and were never produced.

This can be catastrophic for a party like the storm as it can destroy credibility or lead to inferences against the party that the documents were unfavourable at the very least. It can sometimes be seen as contemptuous

Although in Scum’s case, it’s unlikely the worst case scenario is anything more than a rap over knuckles from NRL so likely they’d produce everything requested.

Schifcofske is definitely the one who has more of a headache, if he’s done anything wrong.
