I think he's agreed to terms but has not signed a contract yet to cover himself. This little sojurn is just a stunt like Mundine's back in 2000 to get the Bulldogs to release him. Then he will sign with Toulon after a settlement has been agreed to.

Contracts are still recognised internationally. Western Jurisdictions, regardless of their legal system, are extremely interested in the continued smooth running of commerce.

This has been investigated...

You are right in theory however the common law of australia is sort of different to contract law within the EU.

If th Bulldogs stick to their guns they will come out on top. Simple as that. If it wasn't, this would have happened one million times over in Soccer.

Where will the bulldogs fight this? What court?

As a student of international law. I'm interested.

Erm, one thing everyone seems to have overlooked is that Top 14 squads had to be nominated a few weeks ago. Now, I highly doubt Toulon had him on their list they gave to the FRU, or LNR, or whichever governing body required these lists. It's why Gasnier had to make a decision when he did.

Not overlooked at all. Some sources have actually stated he signed a contract well over a month ago. It must have been stated in this post at some stage, if not it was mentioned on the radio several times this evening by different people.

If you guys think the ramifications of this action was not investigated beforehand by Khoder and his cronies, you have another thing coming.

Once again, for those who have some sort of an idea or are in the know, this was approximately 2 and a half weeks coming.

If he stays out of oz I'm not sure what suing him would do. No matter what his contract says the NRL can't stop him playing a different code in a different country.

yes they can, there are ways to do that

The french govt doesn't like RL and will not issue an exqtr in this situation.

The B-dogs would have to present a good case. and from what i've gathered, there was a significant loophole in the contract SBW signed.

I hope Sonny Bill Williams realizes he will not just be fighting the Bulldogs. The NRL is saying they will support him which effectively means news ltd. Whether or not you like News Ltd. I wouldn't like to come up against their lawyers in court.

If this went to court it would go to an EU court which would rule in favour of a french company. based on jurisdiction of the original contract.

to think this wasn't assessed when sonny signed the french contract would be stupid.

:lol:. It's a business decision first and foremost. Sport won't come into it. And their is this crazy thing called the 'seperation of powers' in France. Here as well too oddly enough.

As long as the Australian court dealt with the matter in a satisfactory fashion, the French courts will recognise it. Contracts for service are remarkably similiar in developed nations.
