I've seen worse tackles not charged and lesser tackles charged.
Didn't have his hand between the legs nor did he employ a driving motion so this is in his favour. However, he did lift past the horizontal and that is against the rules.
By the letter of the law, he has broken the law and he should cop the penalty but it all comes down to interpretation and I'm sure the lawyers will find some angle to try to get him off.
From my point of view, I'll be relieved if he gets off and can play but I will understand if he doesn't.
The thing that always clouds such situations is when you see things far worse get ignored. If the judiciary was consistent, no one would complain but you can bet your bottom dollar that you will see worse not get penalised in future games where less is at stake and this is where things become frustrating.
