Gday to everyone who knew me on the official sharks forum, and hi to everyone else. :)

Just a quick question.

Say this happens:

Anderson takes sharks to court.
Court finds ando is right, gives 1.5 mill payout.

does this effect the salary cap in anyway and who has to pay it (C.S.F.C, Sharks International, etc..)?

SH4RKIES,

It can't go straight to court, and there will be a lot of tooing and froing in the mean time.

Likely scenario if Anderson has a case, Sharks offer Ando the value of next years contract, $400k, Ando says no way I want $1.2m for the 3 years, they settle somewhere in between and we'll never find out the true figure.

IMO, any case that Anderson has is not strong, the club appear to have gone through the correct channels in issuing breaches etc. My guess would be the $400k for next year, plus a $200k sweetener to clean things up quickly.

Either way, coaches don't fall under the cap so no problem there, and the Football Club is responsible for any payments.

I hope your right BS but I can remember BP standing up at the AGM a couple of years and telling everyone how strong their case was against Gow as well.

While that may not have been awarded as much as Gow was asking it was 100K more than BP thought it was going to be, not to mention many of the costs that were accounted for in the just closed period.

Out of curiosity - what was the third breech issued over?

The droping of the Sharks trainer from the Roo tour?

The Three breaches were...

1) The incident at the leagues club that led to hooker Dean Treister and lock Nick Graham being released earlier this year.

2) Abusing a match official in the tunnel after a game, which cost the Sharks a $10,000 fine.

3) The verbal exchange he had with club president Barry Pierce and general manager Steve Rogers after they cut his son, Jarrad, from the 2004 playing roster.

I totally concur with BS on the matter of settlement.

Anderson has a case, so does the club. Both will need to concede ground before any settlement is reached.

I am confident that the figure will be in the range of $400K to $600K.

$400K is the best-case scenario, as we would have had to pay that amount in 2004 anyhow, and copped an unhappy, disrupted team to boot. An interim coach will not cost us anywhere near that.

$600K is my top dollar, and really I see this as the worst-case scenario. There are simply too many documented indiscretions and incidents for Anderson to be able to go for any more than this. In fact, if he does get this much then he should thank his lucky stars. Like BS says, anything over the $400K will be nothing more than 'hush' money.

This is a very different case than the Peter Gow matter. His case involved alleged breaches of various Government regulations, as well as the alleged 'criminal damage' from when he cut up a jersey and the subsequent alleged assaut involving former international player Barry Beath.

The Anderson case is simply a contractual thing, there are no 'distractions' surrounding it as there were in the Gow matter.

Meh the club couldn't wait 5 years for me to become a lawyer now could they?

I highly doubt this will go to court. Opes doesn't want too he just wants a pay out, the sharks don't want to they just want it over and as cheap as possible. Plus both sides really have f**k all to argue over in court... It would be a waste of time. A settlement is the most likely outcome I think. But it would be more than 400k. I'd say around 600 if Opes wants it over quick. But then again he might be a f**ktard and drag it out as long as he can.

Opes breached his contract 3 times I don't really see what he can agrue in his defence :?

A lot will depend on where Anderson ends up next. There is already a very strong rumour about him going to Canterbury - probably a rumour, who knows, but I'm sure he will get a gig somewhere, be it in NRL or UK.

Either way though, it is still a hell of a lot of money and, with Ando's history of acrimonious departures from clubs, this should have been forseen and appropriately mitigated against. The buck stops with the Board and it will be very interesting to find out where this money is going to come from.

If the Football Club pays this, this is money that could have gone into investments, infrastructure, retiring debt or junior development. Instead it goes to silencing a guy who had the effrontery to ruffle a few feathers. In my opinion, this is dead money and next thing we know, there will be an appeal to us fans to contribute to the "Get Rid of Ando" fund.

Enough of the nepotism and personal junket guys. I think it is high time for the Board to fall on its sword and take responsibility for this mess.
