It is a requirement by law that criminal checks are done when you have a chance of having contact with other people or children.

Thats not true cat, all you have to do is sign a form saying that you dont have any previous child-related offences. I know this cause i had to sign one cause i work with Youth and because am a nurse who has the potential to work with kids

You sign the form and they still check it. :p

Otherwise a paedophile can sign that they didn't have any offences when they could have 90.

You sign it, they check it.

When the employer runs the check [which is a requirement] they are informed if the applicant is offence free or not.

If an applicant did posses a prior, details are not forwarded, but the employer is notified that the applicant has a prior.

A department within my organisation carries out this process.

If an employer had someone sign the form, but did not run the check then they leave themself open to their own liable devices.

No, this form isnt a release to check your record, its just a declaration. It doesnt give them permission to check anything, a criminal record check is something different.

Think of it this way Vippo.

If I had previous child offences and I just signed a form saying I didn't, do you really think it'd be all good?

They obviously do a check... how can you say that they believe everyone because they signed a form?
