How was Hayne meant to know this was going to come up? The initial case went to a DA 2 years ago and he dismissed it completely as there was no convincing evidence to convict Hayne if anything. As if you'd think about something like that.

It is scheduled for hearing in court in April, but a settlement may be negotiated before then.

It's not just about whether she suffered emotionally or physically. That suffering has to be deemed to arise from the behaviour of the defendant, and that behavior needs to be deemed (on the balance of probabilities) from an assault or sexual assault (in cases of this generic type). Suffering harm is not in itself enough for a claim to be successful.
