From this picture, I have little doubt that Bird SHOULD be cleared.
Carmont is bent at the waist, leaving his legs up in the air.

The "past the horizontal" thing should only upply to the upper body, and as seen in the photo, he looks pretty horizontal to me.

If you look at the fence, it slopes to the right, as does the ground. Carmont's back looks pretty horizontal and parallel to the ground for mine.

Looks ok to me, wasn't like it was intentional, you see it week in and week out, the usual result a penalty thats it.
