Lockyer 'could sue over CCTV claims'

September 18, 2008 - 7:28PM

Legal action may be considered by the Broncos after a Brisbane venue released CCTV footage claiming it showed captain Darren Lockyer tackling their bar manager.

A leading lawyer said Lockyer would have grounds to sue if the allegations against him could not be substantiated.

ABC TV aired security footage from the Casablanca bar at Paddington, in inner-city Brisbane, from September 6, claiming it showed Lockyer tackling the venue's manager Terry De Gunten.

The fresh controversy comes after Brisbane detectives interviewed fellow Broncos Karmichael Hunt, Sam Thaiday and Darius Boyd over the alleged sexual assault of a 24-year-old woman in a Brisbane nightclub toilet last weekend.

But unlike the sexual assault allegations, the Broncos will not launch an international investigation into the CCTV controversy despite Cullen admitting he can identify "a couple" of players in the footage.

For the first time since the allegations broke, Cullen on Thursday fronted the media to back his skipper.

"I am very upset about the accusations against Darren when clearly there is a lot of confusion about who was there," Cullen told reporters.

"And clearly (there is) no evidence that Darren was there."

Lockyer denied the accusations on Thursday night.

"I don't want to justify it anymore by making any further comment," he told Channel Nine.

But when asked if he was in the footage, Lockyer said: "I don't believe it is."

Cullen not only ruled out Lockyer appearing in the grainy footage, he denied that the bar manager was even tackled.

"It's not a tackle, it's something you could describe as a bit of a hug," he said.

Asked if he could name the players he recognised in the footage, Cullen said: "I'm not prepared to say".

Lawyer and Queensland Council for Civil Liberties vice-president Terry O'Gorman said if the allegations against Lockyer could not be substantiated, the Broncos captain would have grounds to sue media organisations.

"If Lockyer was not in fact involved in the physical altercation and if in fact he is not shown in the CCTV that's been released by the publican then he has a strong case for defamation," he told AAP.

"And unlike most people, Lockyer's got the money to run it."

Cullen believed the venue had broken the law by releasing the CCTV footage.

"We have been advised that we shouldn't be looking at it unless we are in the company of police or the licensing commission," he told ABC Radio.

"We were asked about it yesterday and the legal advice that we got was that that vision should only be made available for the licensing commission or the police.

"So we are not too sure about the legality of it being handed over in the first instance."

Cullen only addressed the CCTV footage at his doorstop but earlier foreshadowed an off-season review of how alcohol was managed by Broncos players.

"This will be part of an end-of-year review, as we do every year. That will come under heavy review," Cullen told 4BC radio.

"Our structure at the moment is that we haven't got an alcohol ban."

Cullen also backed the recent call by NRL boss David Gallop for clubs to end the "see you on Monday" mentality.

Gallop urged clubs to remove temptation and end unsupervised, lengthy breaks for players especially after Friday night games.

"David has come up with a point. Particularly the Friday night game that leads into a Sunday game and there's a nine-day break and the guys feel it's an opportunity to let their hair down a little bit," Cullen said.

"Unfortunately at times, that has led to misbehaviour with players from other clubs - again, I'm not talking about our incident."

The Casablanca bar is yet to officially complain to police.

But Casablanca's manager De Gunten told ABC Radio that Broncos players were loud, drunk and scaring other patrons on the night of September 6.

He said he intervened when one of the players took bottles of alcohol from the club onto the street.

He urged other venues to report any NRL player who causes trouble.

However, Brisbane nightclub Uber has lifted its ban on high-profile players after just one day.

The club will on Thursday night host a party for surf brand Surf Dive N Ski that had "several Broncos players" on its guest list, according to Fairfax.

But a Broncos spokesman said no players would attend.

Meanwhile, Broncos major sponsor WOW Sight and Sound released a statement saying it supported the police investigation of the sexual assault allegations.

It did not say whether WOW was reviewing its sponsorship but would make an informed decision once the facts were clear.

The queue of CBD business proprietors trying to get some mileage out of this must stretch half way across Brisbane...

So, with Lockyer now apparently able to sue according to teh above article, have we all settled down yet and admitted that this Lockyer tackling story that emerged only a fortnight after the event is indeed minor, compared to the cubicle bandits exploits and in fact wouldn't have been in the news at all were it not for the trio's shenanigans?

I doubt I should hold my breath waiting for drizzle to apologise...

And especially for him.

It wasn't just him who was all hot under the collar about this "major" story being newsworthy in its own right...

Bennett chides media 'muck raking'
Phil Lutton | September 19, 2008 - 12:14PM

Broncos coach Wayne Bennett has broken his silence on Brisbane's scandalous week, assuring fans his side's mind is firmly on tomorrow night's do-or-die clash with defending NRL premiers Melbourne.

Facing a massive media scrum this morning, Bennett said he was happy with the club's handling of the crisis and accused media of "flogging a dead horse" after repeated questions about sexual assault allegations levelled at three Broncos players and further allegations of abusive and drunken behaviour.

A clearly frustrated Bennett also took a swipe at the media's handling of an incident at Paddington bar Casablanca, which saw the club's manager allege he was tackled by Brisbane captain Darren Lockyer.

Bennett accused the media of "muck raking" and said he had no idea if Lockyer was involved in the incident, while grainy CCTV footage doesn't appear to identify the Broncos' skipper.

"I thought that it showed the worst of journalism, personally. It was just a lot of muck raking and it was quiet unnecessary . But I'm not the keeper of your ethics," Bennett said.

"Whether it's Darren Lockyer or not, I haven't got any idea. I haven't even bothered to look at them. I'm not mildly interested. But he does have a tackling problem, so he was trying to get a couple up.

"At the absolute worst, whoever it is it was a bit of skylarking. And if we've got that serious with our lives and that becomes a national debate about what we're doing, we're all in a lot of trouble.

"You can all start having a look at yourselves for a start. None of us are immune to having a bit of fun in our lives."

After a week where the Broncos have been criticised for failing to show adequate leadership, Bennett stood tall today as he approached his final game at Suncorp Stadium.

He declined to comment on whether alcohol was a problem within the walls at Red Hill but said his young players weren't immune to the binge drinking issues facing Australian youth.

"You allude to a drinking culture. Unless I'm totally wrong, unless the government's totally wrong, Australia has a culture of young people drinking too much alcohol. We're not immune from anything that happens in society," Bennett said.

He steered clear of any of the sexual assault allegations facing three of his stars, saying the club had moved on and admonished reporters for trying to "flog a dead horse".

"The club's been really strong this week about our position with the whole lot of it. We know what's happening inside the club. Bruno's been handling all the parts that go with it and that's the way it's going to stay," Bennett said.

"We're like the rest of you - we've got to wait to find out what really happened. We've been totally co-operative with the police.

"They've done their police interviews. It's all over for us. There's nothing we can do until we get some indication from the police about what direction they're going. You're flogging a dead horse. Why don't you get on with your life. That's what we've done. We can't undo it. It has to take its course and we're all moving on."

Bennett said the saga would have no impact on his legacy at the club or how he felt when he leaves Brisbane at the end of the season to join St George Illawarra.

"I have no control about how I leave the Broncos except the way I leave the Broncos. Understand that? I'm more than happy with my time here and what I've done. Regardless of what happens tomorrow night, what's happened last week, it's immaterial to me in the sense of how I leave the Broncos," he said.

You just got owned by badav. You'd believe the footage showed lockyer raping the bar manager if the media fed it to you, you're that desperate to jump on anything negative about the Broncos.

Haha he did. One of the most dumb things I've read during this whole scandal.

It does look like Lockyer in front of the counter, but is it him who was "semi tackling" the man?

Either way, this is still pretty much a non-event.

But does show the media are targetting players big time. They clearly are asking whats happened to the Bronc's hardline approach? Seems to have taken a twist while the finals are on. Anyway I am happy for the full squad to play as I want the broncs n storm to bash hell out of each other! Go Broncs...........Go storm

Why should they drop players who haven't been charged with anything? If they are charged i would be happy for them to be suspended until the matter is resolved.

Its not really all that different to what happened with the Bulldogs in 2004. And that player was able to play all season including in the grand final and remain "anonymous" (for the most part).

I hate the broncos more than any other team in the comp, their arrogance is at times astounding and most of the fans that i know (including close friends and family) are just blind to any negativity surrounding the club. If you hate the broncos you must just be jealous of them, it cant be any other reason. Theyre great at telling each other that.

However...

THIS story re: the bouncer tackle is complete horsesh*t. The footage is horrible, it shows nothing conclusive, the "tackle" is the softest shove ive ever seen and this manager is lying through his teeth about fearing for his safety.

Charlie, if the footage is inconclusive (and I agree that it is), how can anyone make a judgement on it? Therefore, how do you know the publican is lying???
