McCracken deserves to be compensated, his career was cut short by an illegal act, I'm not saying Bai and Kearney should pay, I'm sure it was never thier intention to end his career. There should be some sort of fund to pay players who suffer these sorts of injuries, weren't the Players Association fighting for some sort of fund at one point?

I argee he should get compo but only the medical bills should be paid. For any extra compo is wrong, he dream to be a superstar is dashed and at least he can be in real estate now.

the photo in the Telegraph was graphic and if someone can argue after seeing it then they need help.

as stated before there have been court cases - and settlements reached - no problems - maybe the players should be responsible for their actions not the club...so it's up to the player to take out the appropriate insurance against damage to another player...maybe that fee could be left out of a aslary cap and be recompensed by the club..

However, I don't belkieve that Storm said "take the mongrel out with a spear tackle"..

you do the tackle you take the consequence

Anyway, I think it's fair for McCracken to have his day in court. He certainly has a case but none of us can really say either way what the right decision will be at the end of the day because we don't know all the facts, nor are we legal attorneys (most of us anyway :)).

My opinion is that I would like to see him get some compensation because his career was ended by an illegal tackle. Remember folks, players get suspended for tackles like this because they are dangerous. That's the whole point of being suspended. So I think McCracken may have a case because of the sheer fact that Bai and Kearney have severely injured someone in the act of performing an illegal tackle, knowing it is against the rules and policy of their sport.

It's like anything, really - if you work somewhere and the workplace requirement is to make sure a ladder is securely placed. You place it but don't secure it, a workmate climbs it, falls and breaks his neck - you are the one who is liable because you failed to adhere to rules/guidelines and somebody else suffered as a consequence.

I think that's what it comes down to.

Maybe Tallis can sue Muir and the Eagles? Could sue the NRL to, Muir pretty much got off scott free. After all Tallis had to sit out a year and retired earlier than he wanted to because of his neck.

I think what CS is trying to point out, it takes longer than a split second to realise the tackle has gone wrong, work out how to fix it, and actually pull out or do what ever needs to be done. Most times by the time a player realises things are going bad and something needs to be done it's to late.

And this is my big problem with the shoulder charge. It's not a tackle, hell it's not even an attempt to tackle. It's nothing more than a blatant attempt to hurt someone and the reason it was banned (not sure if it still is) in New Zealand.

Why it's even classed as legal (if in fact it actually is) is beyond me.
