I guess it depends upon whether or not you believe the club had a right to contest the evidence used against them, due process is about that kinda stuff.

I tend to agree the record of interview is important, A lot can be gleaned from the nature of a two sided discussion, such as was there coaching, was there threats, was Seward given information to confirm it's voracity, how confident were his answers, is there any material difference between the record of interview and the written statement, was there issues of which he was uncertain or reluctant to address, did that reluctance or uncertainty change between the time of being questioned and the compilation of his statement? There would be many more.

All valid questions that could easily be answered if one had both records at hand.
and if there's nothing to hide then why won't the Turd hand it over?

I'd be more inclined to ask, after seemingly repeated requests for an explanation as to why they were not made available, why does the NRL deem it unnecessary to provide a reasonable response?

What exactly in their minds constitutes due process?

Due process in my understanding doesn't mean you get to view exact word for word transcripts of interviews given in confidence.

You might get given a summary of the evidence that resulted (i.e. the breach notice which the club received) or you might be entitled to view a document made with the understanding it would be viewed (i.e. the reported 70 page sworn statement, which the club was reportedly provided).

Trying to obtain a transcript of interview given in confidence in addition to the details already provided seems highly unusual in terms of my understanding of due process, and likely to be ruled a vexatious request under appeal. I can't think of any equivalent process where a party is entitled to receive transcripts of in confidence interviews with investigators....

Just an opinion - just my 2c toward us not having unrealisitic expectations about the results of "fighting on".

Due process is about fair hearing to respond to the allegations being made, and the nature of those allegations. That requires the ability to test the evidence being used to prove those allegations.

All the evidence, not just the bits that support the case against you.

Edit

In this example, the raw evidence is the record of interview, What has been asked, what the answers were.

The statement is is an agreement as to what was said in that interview, these are by no means the same thing.

Well the "all the evidence" is the bit I think is debatable.

A summary of the allegations made (by the investigators, i.e.the breach notice) and a summary of the evidence held (by the investigators) would suffice imo. Especially in the case of not releasing any transcripts of interviews given to investigators "in confidence" - and especially when a subsequent 70 page sworn statement from the witness in question was already provided to the club.

The fight for "due process" is fast turning into tin foil hat stuff imo.

Sent an email off to Mr Grant giving my blessing to sack these leaches and it felt gooood.

Sent one too, suggested that the club needs a restart and that we should look to appoint someone like Bernie Gurr to commence revitalising the club and game. Said the Eels were too important to people west of the CBD not to take action

Hope he got a few more

I actually think there is an element of 'scorched earth' to it all. The former directors know it's over for them. They just want to bring the system down. Player managers, rival clubs, the NRL... I hope they all cop the blowtorch.

'Level playing field' my anoos.

What's the point in appealing? Someone explain to me because I'm lost with what's happening and why
