Probably because he didn't tackle the Tigers player in mid air - he contested a kick, which he was beaten to. Afterwards he can't disappear, can he? Even the Fox commentary team - who death-ride Saints from go to whoa - were of the opinion that it shouldn't have been a penalty. Also, he didn't deny the Tigers player a try-scoring opportunity.
