Rugby Australia to target top NRL talent - Lomax case settled

It’s not difficult to join the dots on what a half decent agent will be working to address.

- How to get the biggest number possible – same as any other contract negotiation.
- How to mitigate the start-up uncertainty – guarantees and/or escrow payments, ala LIV.
- How to maximise earnings in a potentially limited window – if the competition doesn't oblige players to live where the franchise is based, then its just meeting existing foreign tax residency rules, ala F1 drivers, golfers or the thousands of ex-pats already working in tax-friendly jurisdictions.

None of that is is new or particularly challenging for a competent management company.

This may have been asked already.
In the event this doesn’t get off the ground and completely falls over, what happens to Papenhyzen, Lomax etc. Can they put themselves on the nrl register? How would their value be set. Is there a legal recourse against the union mob?

None of that is is new or particularly challenging for a competent management company.
10 year ban for agents too. NRL can simply deregister them. It is a huge risk if you have a big stable of NRL players.

I think everyone can see that's ripe for challenge. In fact I've always thought the NRL knew that too, and only released the policy to try slow things down while the details play out.

They can try to.

Far more likely they become superstars representing the Waratahs in front of an enormous 4,500 crowd at SFS.

For an official player agency they can deregister who they like. Isaac Moses was previously banned. He did not contest it IIRC. That's not employment law.

They can challenge it and win. There is nothing any court in Australia can do to force an employer to employee a specific individual.

Yes but he got around it didn't he, by letting his cousin (IIRC?) run the shop in his stead.

Not suggesting that tactic would necessarily work again but when so much money is involved, few die wondering.

Yes but the goal wouldn't be to force the NRL to employ someone, its only to prevent them from refusing to register a contract based on a blanket rule.

After that it's on the individual clubs and whether their ambition to win games overrides whatever indignation they originally felt. A few of the 17-19 might hold onto the principle of it all, but not everyone. As has been pointed out, eventually self interest will rule as it always has.

When Sonny walked out overnight, still actively contracted let alone released, the condemnation was universal but we all know how that eventually turned out.

Appears that way - all the noise has been that this will be the case. Maybe you know better though.
Just like you knew better about Vegas…..
I’ve deployed overseas on tax rulings made by the Government that made my income tax exempt. It is not exactly anything new. I can’t imagine who would be launching a high court challenge either and doubt whether it would even be accepted by the High Court.

I think Lomax went from Saints to Parra for less money - not sure how this idea would have changed anything
I doubt any team would even use a marquee slot on him. It's more so we keep the likes of Walsh, Cleary, Katoa, Herbie, Haas, etc.

the reality is that two of the game’s best players in Zac Lomax and Ryan Papenhuyzen have left the NRL with time remaining on their contracts.
Even if they aren’t R360 bound, has the prospect of that competition planted enough of a seed for some of the game’s best to start considering a move?
And that’s even before we get to the fact that Payne Haas is weighing up a payday which could see him pocket $3 million a season.

This move hasn’t come as a surprise to the Eels. Word of a post-game conversation between Lomax and fellow heavily-linked R360 prospect Roger Tuivasa-Sheck quickly made its way back to the Eels after Parramatta took on the Warriors in their round 26 clash in Auckland.


Some at the Eels had been warned against signing Lomax given the way he exited the Dragons, but his form last year was so good they thought they had a match winner on a long-term deal.
He gave Parramatta good service but the reality is that it lasted just 19 games.

For the Eels, they have cleared significant money out of their cap. Lomax was signed as a centre under former coach Brad Arthur and new coach Jason Ryles was willing to give him a crack at his preferred spot.
But Ryles soon followed Shane Flanagan’s path from last season and realised Lomax was one of the game’s best wingers.
It is why Lomax made his Australian and NSW debut despite a reluctance to play on the flank at the Dragons. He didn’t play another game for Parramatta at centre after round five.
Parramatta’s interest in former Storm big man Nelson Asofa-Solomona is genuine and now they have some money to pursue the Kiwis prop.
They still have Ryan Matterson on their books with the one-time NSW forward due to return in a week for pre-season training.
As for the NRL? Well R360 apparently wants the players they have signed to start making formal announcements within weeks.
It could leave the NRL with the worst kind of Christmas present especially if Haas finds a big pay cheque under his tree.

I hope Lomax is well advised and has done his own due diligence. If r360 does kick off in less than a year from now, it will be a rush job, which potentially threatens the viability already in year 1. R360 are better off launching in 2028, after the RWC.

As for the NRL, get the tv deal done over the next few months, which would hopefully give more financial certainty to the players and the code as a whole.
