Did Kaufusi's tackle happen before or after Mattos last Contract upgrade? You know that.

I have never said the tackle happened before his last upgrade.


So every concussion after the Kaufusi initial one won't be able to allow him to get a medical retirement? As we know this is the point you are trying to make.

Because you know that won't ever be the case...

If its ongoing, "from the Kaufusi tackle", its exactly the same.

This is a fascinating discussion - but surely you would know that it would be almost impossible to prove that the Kafusi tackle was the definitive concussion that lead to retirement.
Especially since Matto has since played.
And even if the NRL could prove that
Wouldn't they then be under a duty of care issue where they let a player who should have retired play on (and so it might be in their best interests to say 'new injury medial retirement')

It would seem a fairly open/shut case of 'new concussion/ medical retirement'.
If that is the current issue (or is it his back?)

Who knows - he may just be a pea-heart?? Unfortunately that isn't a new medical issue, he clearly developed it at Wests and brought it here with him.

PO is an offer to enter into a new Contract. Matterson has a new Contract with Parra until 2026. Parra would have to do their due diligence in this case. Im not the one making the decision for Parra, Matterson or the insurance Company. When Parra and Matterson signed that new deal, Parra is taking the risk that Matterson might not finish the Contract due to his pre-existing conditions, and if not they may not get paid out by the insurance company or might not get an exemption under the cap. That is the risk they take and I can only assume that they have weighed up this risk based on the information they have.

I don't think it's quite the same as an offer to enter into a new contract with a player whose deal is expiring. The due diligence is done when the option is granted (whatever year Matto signed - 2022?), not when it exercised by the player. Parramatta cannot withdraw from the process at that point. So in terms of injuries, retirement, insurance, I see it as exactly the same as if we'd signed him through to the end of 2026 without any options.

So if Matterson turns up with ACL, PCL , MCL ruptured in both knees, the Contract is actionable?

Yes, the contract is still executed. But you can then seek to have it terminated as you would in the case of anyone else that is medically unable to perform. And you bear the same consequences. It's a player option.....the writer of the option (the club) has no choice but to do what they agreed to back in 2022.

Lucky thing we lost Brown. Imagine if his ACL injury came back after he took up option
