The non compete clause is the reason he got a release . If they rule the clause is void then the release may well be void as well and he’ll be expected to honour his contract until we’re satisfied to give him a full release. If that happens we can all see him breaking his contract and refusing to show up in which case he’ll be looking for a rugby union club .

I've made clear I don't know enough to have an opinion. That's why I'm asking questions. But if your answers sound like bullshit or are full of holes, don't expect me to keep my stupid mouth shut. I didnt say the same thing at all, I pointed out that its federal law, not a state law and the court doesnt look at previous cases as a guide, the court is literally bound by previous decisions. It is what the law is.
Previous decisions are a guide because no two situations are the same.

my view is that the club probably had this application in the works for a few weeks and have kept their powder dry… once the nrl got involved the club knew they would have to go to court and enforce the validity of the release and restraint to exert authority over lomax and ensure that anyone who wants him has to pony up.

it’s my experience that you would not commence this application nor issue such a detailed and particularised press release unless you were very confident in the advice you received.

Yes. We would have had our lawyers (T-Boon Legal and Conveyancing) look over the release conditions very carefully and also ensured that Lomax had a lawyer sign off on it as well.

Yeah they don’t want to do work either.

I can’t see us giving up now but now Lomax has to pay lawyers and do some work, I think there’s a good chance he may ask if he just goes to Japanese rugby for 3 years that we pull case
