It’s just terminology, I’m not trying to conflate what’s legal/illegal. If we argue successfully and stop him playing for Scum without our consent, we’ve restrained him from plying his trade.

No again he restrained himself by saying he didn't want to play rugby league.
We aren't stopping him going to another rugby league club but we just want a trade in equal value

If he could restrain himself then it stands to reason he could unrestrain himself though. Him saying he doesn’t want to play anymore is a part to the validity argument of the restraint.

Exactly, without an accepted return we are stopping him from playing for a specific group (the specificity is also a part of the validity argument). We’re getting back to indentured servitude.

No contracts can't be broken because he changed his mind....

He has now agreed to 2 contracts at the Eels the first where he agreed to play for the club for 4 seasons. This where the club gets sponsored by companies with the knowledge Lomax will be at the club which will also be part of the trial btw..

The second contract he agreed to was departing the club as he did not want to play rugby league anymore so the club and he agreed on a new contract where he got something and where we also got something. That's typically how a contract works.

But nor can you contract out of law. The law is you can’t contract into a restraint of trade, BUT FOR these situations X, Y, Z. Those situations don’t change it being a restraint of trade, it just makes it allowable to those situations.

Lomax changing his mind isn’t by itself one of those situations.

The Storm have done a great job for the NRL in Victoria. Their success is responsible for thousands of NRL fans who would not have been NRL fans if it weren't for the Storm's success.

Credit for that at least. They're still a pack of merkins, though.
Other than cheating the cap on several occasions, one them possibly costing us a GF, we agree to disagree, their ethics are non existent
