I just dont understand how that argument can be used successfully

wouldn't everyone use that argument if they thought they could get away with it and no one would ever been found guilty of shoplifting

9 times out of 10 a shoplifter wouldn't scan the goods before stealing them

That is a completely different scenario.

Andrew Johns made a 'racist' remark. If i was to call someone a 'bloody ranga' and then say i didnt mean it, it would be stupid because the fact that i had to use those words to describe someone shows that i in fact did mean what i said. I don't think there was any malice behind the words, but he still meant them. Had he used those words on say, Billy Slater, then he would not have meant it.

As for Ozzie. He walked off without paying for something because it slipped his mind. I highly doubt a CEO would need to steal something so small when their whole career might be at stake because of it, especially when he is a regular customer there and was wearing a Parra jersey. That whole incident was blown out of proportion.

One shows a weakness in character, the other just shows human error.

I'm sorry, but that's a load of crap. If I or any other person walked into a supermarket and was confronted with the same situation, I would definitely know whether or not I had paid for what I purchased. I find it unfathomable to believe that you'd forget about something like that for days or even weeks until you get caught.

Steal Suitmans number plates beforehand and put them on your car, just in case they write it down as you speed off. Well on reflection you might want to drive off slowly and wave to them since the cops will come knocking on suitmans door

Apparently, a few old codgers believe it is entirely possible and something of an everyday event because paying via card at a supermarket is one of the most daunting tasks and near impossible to adapt to it.
I'm not so quick to discount Ozzie's mere stupidity as an individual.

The prosecution have to prove matters beyond a reasonable doubt. Osborne's excuse that he forgot it was in his bag and he intended to pay for it (as reported, I don't know that is was it is) would raise doubt. A number of things would have to be taken into account when this defence is raised. Things like does he have the ability to pay for it i.e. cash, credit cards, eftpos cards in his possession at the time. This is the sought of circumstantial evidence that may prove or disprove the defence.

I am not here to argue Osborne's case but sometimes, believe it or not, people forget things. That is why you can't have things that are black and white at law. I am sure plenty of people drive off forgetting to pay for petrol. They are not all going to get charged with stealing.

I'm not so quick to discount Ozzie's mere stupidity as an individual.

Apparently a few kiddies, who's biggest worry week to week is how much of their pocket money do they spend on beer and how much on food, don't understand that being the CEO of an NRL club, plus being the father of a million kids might preoccupy one's thinking.
Stress and exhaustion have a major effect on things like memory...it is entirely feasable that Ossie did his scannning etc and in the process of bagging his stuff forgot that he hadn't also swiped his card.

I have once, up at 2am to head up the north coast fishing. At the servo, half asleep with a mate, I get out, put 100L of diesel in the 4wd, and another 300L of fuel in the boat. Mate walks off, goes into the shop, comes out with munchies and we're on our way. About an hour later I asked him for a receipt, alas no petrol listed. D*ckhead.

Totally agree.

As much as I'm not his biggest fan, I don't think he set out to do anything deliberately criminal. Without the mens rea there is no case.
