OK you got me that I am not a Doctor, but Contracts are my 9-5.Did the Eels get a chance to not resign him post the 2024 concussion? Or did Matto take up his option?
An option is not a Contract, it is an option for one party to enter into a Contract under a pre-determined set of conditions, but the Contract (and any Contact) has to be a new Contract that has form, consent, offer and acceptance, legality, intent and consideration. Both parties must intend and be able to complete the terms of the Contract and provide the consideration outlined in the Contract.
Part of that is the capacity to carry out the Contract. At this point of a new Contract, Parra must have conducted a medical which I can only assume would have included the information from his 2024 neurological testing. At this point Parra have made the decision that he is able to provide his end of the Contract. What does this mean if/when Matterson says he cant play due to concussions? This is of course the whole point.
My whole argument in this thread hasnt been can or should Matterson be medically retired due to concussions, it is whether Parra would get cap dispensation. IMO Parra may be running a much bigger risk with the Contract and whether the insurance company would pay out (see Anthony Watmough).
