The Rugby School rules as written and published was the first rugby code but nobody plays that anymore. Rugby and Union both draw on those rules but neither is played to those rules.
If they original "rugby code" as you call it no longer exists then its claim becomes non existant, then the next code that played Rugby football has first rights to the name. and thats the code the RFU was in charge of.
