As for Gorilla's bold statement, lets see if we can flesh it out:
First the law:
(a) Murder shall be taken to have been committed where the act of the accused, or thing by him or her omitted to be done, causing the death charged, was done or omitted with reckless indifference to human life, or with intent to kill or inflict grievous bodily harm upon some person, or done in an attempt to commit, or during or immediately after the commission, by the accused, or some accomplice with him or her, of a crime punishable by imprisonment for life or for 25 years.

Some facts known
Old mate died of a heart attack. Johnsy's mate the coroner has found that on a preliminary basis.

The Police admit to multiple blows to the legs, I am not sure how many, so a question may be whether those blows could have hurt his heart.
Lets see what the experts say:
Heart attack also can occur due to problems with the very small, microscopic blood vessels of the heart. This condition is called microvascular disease. It’s believed to be more common in women than in men.
Another less common cause of heart attack is a severe spasm (tightening) of a coronary artery that cuts off blood flow through the artery. These spasms can occur in coronary arteries that don’t have CAD. It’s not always clear what causes a coronary artery spasm, but sometimes it can be related to:
Link?
I see above that pain is a cause of heart attack. I imagine that multiple blows to the leg area are painful. He might also have suffered from acute emotional stress. He was in an upset state before the cops arrived, their arrival and conduct would have accellerated that.
So on the one-hand, Gorilla's submission may not seem so fanciful.
But the cops can maintain they had a cause, they can say that they were trying to be careful ( ie not reckless, not trying to committ a gbh, but followed the manual) and
besides all of that, werent in a position to make a judgment about his pre-existing heart condition. He may not have known of it.
The last thing the cops wanted was an actual death. Thats why they worked like dogs to save his life. Where was the intent to kill? So it might be reckless indifference or the gbh they would be looking at to charge the cops under.
And the case is way too big for a cover up, I imagine that everything will be squeaky clean in their investigations.
Anyway, Im not reaching a conclusion, just thinking about it. No doubt the cops on scene have been interviewed 100 times already. Under a lot of pressure Id say.
Ive heard they are going OK at the moment. But if they get charged, jeez....
You speak to ex-cops, a lot of them feel very let down by the Force. Theres a general feeling of bitterness about their ex-employer that you dont often find in other people.
Until its over everyone will be a mate, but if they are charged etc, then they may well be ex-communicated. Tough gig when coppering is not just a job, but a lifestyle.
