I know the story. Gus snd Ivan werent sold on him until after his debut. No doubt due to his poor work ethic off the field.
After a single game though he was Ivans fullback. He did not choose Whare or Naiqama over him.
The second tier salary cap was also stopped him getting a run earlier. He wasnt in the top 25.
If you are just referring to Ivan's case (I was also thinking of Griffins situation) then sure, consideration is an issue. I'm really referring to what happens in practice, not the strict legal interpretation as most of the time it doesn't get to that in these scenarios. Cleary would have a notice period in his contract as would the club. Agreement to shorten it is a commercial negotiation. CEO's and players leave high paying jobs for something better all the time, it really just comes down to money in the end.I dont necessarily disagree (that much) with anything you have said but it is besides the point? In all of the instance you list here, there is still consideration for both parties, one wants to break the contract and the other receives his (potentially negotiated) payment. In the case of say Cleary walking out the door (or SBW out the Bulldogs door), what consideration do the Tigers (or Bulldogs in SBW case) get? There isnt any.
Keep in mind that I haven't brought this up as an opinion of the rights and wrongs in this particular Cleary case, I merely brought it up because I have seen many people say "well its just the same as when a club sacks a coach or player". Its not. its totally different.
And by the way, on a totally different angle, inducement to break a legal binding contract is illegal under tort law.

I don't know whether Gus wants Cleary or not, but Gus has just said that the Board wanted Griffin gone and he (Gus) wanted to give him more time. Fletcher, in the on air interview, said the board sacked Griffin on Gus's advice. So who's telling porkies?I actually believe Gus on this Cleary thing.
