For one thing events after the incident would have absolutely no bearing on a damages claim. Has nothing to do with whether or not there was a tort was committed.

Worked for 2 years as a personal injury solicitor and I have NFI what would/will happen if a claim is brought.

Any claim would involve the top silks in the area.

Are we supposed to be surprised that the NRL have let go tons of worse tackles this round?

f**king joke and most people called it. A token ban for McLean and that's it.

Same situation with Snowden, same situation with JWH collecting that soft merkin Stewart a little high.

You only need to worry about being hit with a lengthy suspension by the NRL if there's a freak injury, otherwise go ahead and hit people high or drop them on their head :crazy:

great theory......

if they want to stop the incident from happening again, they need to be consistent in penalising lifting and beyond horizontal.

So you think they don't have a point? How are you supposed to rub out these tackles from the game when they only suspend a player every 20 years because of serious injury? It would have sent a serious message that they weren't taking the subject lightly.

They made an example out of McLean but have basically said now there actually isn't anything wrong with the tackle.

It shows that their zero tolerance stances on punching/shoulder charges are media driven and not welfare driven. The NRL really has dropped the ball on this, and sadly we'll need a media campaign to get lifting out of the game as well, which will only bring more negative publicity to McLean and McKinnon.

Absolutely.

I know from some of your past posts you don't like our game being reduced by having players out for minor offences, and I agree with you on that.

But to only suspend for accidental injury is just as bad. And lifting between the legs adds nothing to the game as a spectacle, and can only have dire consequences when it goes wrong.

Snowden and JWH got big bans for accidents with regular technique, but dodgy lifting that does nothing for anyone, and has just put a guy in hospital and maybe worse, gets 1 unlucky guy 7 weeks and nothing for anyone else.

It is very weak from the NRL.

I assume your quote of Dan Walsh's was an accurate reflection of what originally appeared...if so, it certainly reflects the poorest and most crass type of reporting that is being delivered. And you would have to think you wouldn't be that dumb to use that turn of phrase accidentally, which means it was a conscious decision - and on that basis I would at least expect a public apology and I'm inclined to agree with IBM that it was an utter disgrace and sacking could be a consideration.

I would have to wonder though whether there is an editor above him that would have seen this and also let this go through?

Alex McKinnon has improving use in his right arm and has some movement in his left as he continues his long road back to recovery following a devastating spinal injury.

The Newcastle Knights back-rower has been transferred from intensive care to a spinal rehabilitation ward in a Sydney hospital after injuring his spine while being tackled in a match against Melbourne last month.

McKinnon is able to control an electronic wheelchair, the Newcastle Knights said in a statement.

“While there is a long road ahead for Alex, these small improvements continue to lift his spirits, as does the overwhelming amount of support he is receiving,” the statement read.

“Alex and his family wish to thank the medical team at Melbourne’s Alfred Hospital, for the acute care and treatment following his injury. They also wish to thank the hospital staff currently managing his progress.”

‘‘As previously advised, further regeneration may occur over a two-year time frame.

‘‘The club will continue to share any appropriate updates on Alex’s condition and again request their privacy be respected.’’

this is just magnificent news.

Here's hoping that the recovery continues at its current rapid rate (given the extent of the injury)
