CC Bears Should take Legal Action

Should the Central Coast Bears not be given the green light for expansion by 2014 (at the latest), then they have very strong legal case - and should sue the NRL and News Limited immediately. The grounds are very strong.
  • The NRL made a promise to give the Bears a regional licence - a promise which was wrongly circumvented;
  • The 'insolvency" call in 1999 was a fraud - the events surrounding this will be exposed in any court action - and there will be a lot of nervous people if this happens;
  • If the Bears were "likely to be insolvent", then at least 8 other clubs were in a far worse financial situation (and still are).
The restoratuive and punitive damages would be massive.

I, for one, hope that this legal action takes place - on behalf of all Bears' fans and Central Coast fans who have waited over 10 years for the original promise to befulfilled.

It's time to deal with thes dickheads with a big, big stick.

I'd hate to be the legal practitioner that has to sign off on the 'reasonable prospects for success' certificate...

Exactly. But only because they stood up to the NRL at the time instead of rushing into a merger to save themselves. And they were lucky two of thre three appeal judges didn't agree with the original judge, and that David Moffett allowed them back in when he actually didn't really have to.

And in any case, this is the Central Coast Bears, not North Sydney. So how could they possibly take action against the NRL? It was North Sydney that was dudded right?

Nothing against the Bears or the Central Coast but I don't believe the game needs them if they are just going to make a 10th Sydney team

Unless the NRL cuts other Sydney teams from the competition.

I'd quite like the bears back in the comp, in whatever form it might come. I enjoyed the rivalry between our two clubs until super league came and shitted things up. But if the CC bears miss out on an expansion slot, any disappointment would be tempered by amusement at the righteous fury spewing from camp Ronny.

The NRL told Souffs to f**k off, so what do they do? Take the NRL to court.
They LOSE the court case, they still don't get the message and appeal.
They get a judge who happens to be a souffs supporter and win on appeal.
The NRL then says fair enough, we'll let you back in.

We didn't want Souffs back in the comp and we sure as hell don't want Norffs.

One thing I have never been able to work out is the workings of the courts and how they make their decision.

Not sure what you mean, Goddo? Please don't accuse me of something I haven't done. Greg Florimo is meeting David Gallop on Thursday to clarify his comments. Flo will let us know the outcome.

Till then, anyone gloating at delayed expansion should hold fire.

Why not get out and support your local bid, the Ispwich Jets? After all, you don't even live in NSW.

Pity your reasons just aren't very good.

The only point any QLD bid has over the Bears is the TV advantage, which imo is exaggerated. Furthermore, there are countless things that can add to the TV deal which would detract from the quality of the competition. Presumably you aren't a fan of all of them.

-Networks deciding on match scheduling a few weeks in advance
-Monday Night Football heavily affecting crowds
-according to the networks, heavy delays in Perth, Adelaide and Melbourne are far more profitable to them then showing the game live.
-the top 8 finals format has been heavily criticised but exists purely for profit at the backend of the season, more finals games for TV at the cost of a more prestigious, fairer system.
-more live stoppages for ad breaks would bring in the $$$
-more that I can't think of right now

Fact is that supporters of the game tolerate a lot of crap for the benefits of TV dollars. The Bears tick every box except come at a slight disadvantage to a QLD bid in terms of network appeal. The difference in TV dollars between the Bears and Brisbane pales in comparison to the above points + the effect of bringing in Perth. Time for the NRL to do the right thing by the fans for once. The Bears will represent a massive area of NSW and Sydney that should never have been stripped of their team to begin with.

That all said...Ronny is a loonie.

Court would in my opinion be a bad move. The Central Coast Bears will keep signing members and sponsors. Build out credentials and fan base. That's all we can do.

But before the naysayers have an orgasm, let me remind you that the CCBears recently signed on more sponsors. While you all might have a field day today, rest assured that the bid is going in the right direction. 7000 members, 25000 fans and 50 sponsors can't be wrong.

People like goddo and alwaysgreen have your little victory today. I'll have mine on the weekend when more people pay their hardearned cash to join the bid.

Good luck Ronnie...this certainly isn't one for no win-no fee. If I were representing Norths, I know I'd be maintaining the fee structure to charge at per 6min increments or part thereof of work completed. Let's have a look at your points:

1. You talk about promises - do you mean that the NRL and News Ltd instigated non-performance of their "contract", as Norths relied on a promissory statement? Sorry big dog, not all agreements are contracts, and this one is NOT a contract. For it to be a contract, (and hence enforceable by law), it needs what's called contractual consideration (i.e. both parties putting something into the contract exchange).

2. How was the "insolvency call" in 1998 (that's when it was decided) fraudulent? The NRL has the right to grant and revoke licences to whoever it wants within its own competition. I don't know a lot about the Souths case, but it's of my understanding it was very Souths-specific. If that case did set a precedent and gave rise to further action from other clubs, then why didn't they do so back in 2002?

3. Says who? And besides, this rationalisation was to be concluded BY 2000....11yrs ago. So no longer relevant, Ronnie.

Now that Tinkler is pouring millions upon millions into Newcastle and the region I'd rate the Bears 100/1 to get into the comp when it is expanded.
Can't see that he'd be too keen on fresh competition up the road and anyone who believes this bloke won't have some considerable pull is kidding themselves.
Perth and Brisbane are the odds on favourites.
