The ‘Act of God’ clause causing more friction between the NRL and Channel 9

The bad blood between Channel 9 and the NRL has intensified with the parties now locked in a fresh dispute over an clause taken out by the governing body.

News Corp can reveal the NRL has formally notified its commercial and broadcast partners it has activated a Force Majeure clause to insulate the governing body financially in the wake of the fallout from the COVID-19 ordeal.

The clause covers all contracts in the NRL’s mega commercial stable - including their $625 million contract with disgruntled free-to-air broadcaster Channel 9.

A Force Majeure is a clause which gives the NRL contractual protection in the event an Act of God, in this case the coronavirus pandemic, affects their ability to fulfil obligations to sponsors and broadcasters.

By suspending the season a fortnight ago, the NRL are technically in breach of their $1.8 billion broadcast deal with Channel 9 and Fox Sports, a scenario that could ostensibly trigger legal action.

But the Force Majeure clause protects the NRL from being sued at a time when the COVID-19 saga could cost the code up to $470 million in lost revenue this season.

Sources close to negotiations say the NRL has no intention of invoking the Force Majeure as a get-out clause to broker new, and possibly more lucrative, deals with other sponsors or broadcasters.

But the move has gone down like a lead balloon with Channel 9, which has questioned the NRL over whether the coronavirus pandemic represents an Act of God disaster.

The contractual clash of beliefs could be one reason behind Channel 9’s savage attack on the NRL on Friday, accusing the governing body of mismanaging millions over the past decade - including a $50 million loan from the free-to-air giant.

Channel 9’s current broadcast deal with the NRL, worth an estimated $125 million annually, expires at the end of 2022.

By enacting the Force Majeure, the NRL has the ability to seek a renegotiation of contracts this season in good faith, with protection for future terms that had been agreed upon when the deal was initially signed.

Contacted by News Corp on Friday, an NRL spokesman said: “We are working closely with all partners to resume the Telstra Premiership and comply with our agreements.”

ARL Commission chairman Peter V’landys said he would meet with Channel 9 bosses in the next week after the NRL were accused of failing to consult the network on their May 28 relaunch plans.

“We will have talks and we will engage them in what we are trying to do,” he said.

There are fears Channel 9 could walk away from rugby league after a stinging broadside that could herald the demise of besieged NRL CEO Todd Greenberg.

“At Nine we had hoped to work with the NRL on a solution to the issues facing rugby league in 2020, brought on so starkly by COVID-19,” the Nine statement said on Thursday.

“But this health crisis in our community has highlighted the mismanagement of the code over many years. Nine has invested hundreds of millions in this game over decades and we now find they have profoundly wasted those funds with very little to fall back on to support the clubs, the players and supporters.

“In the past the NRL have had problems and we’ve bailed them out many times including a $50m loan to support clubs when the last contract was signed.

“It would now appear that much of that has been squandered by a bloated head office completely ignoring the needs of the clubs, players and supporters.”

A moment ago I watched Peter Stefanovic do a story on the NRLs plan to return. Almost word for word was this:

PStef: "The NRL has plans to return to the field on May 28th but Medical Authorities are quite opposed to that idea"……….

Crosses over to none other than Brad Hazzard (current, but not for long) NSW Health Minister who basically states as follows:

Health Hazzard: "No I havnt spoken to the NRL for around a month. I am open to meeting with the NRL about the NRL return"…..blah blah blah.

Not one word in that press conference opposed the NRL return yet the media has worked overtime to just make this sh!t up. Outright lies.

Are we to believe this from a network that's covered the game for a while, putting down the game left right and centre, terrible coverage, terrible commentators, sacking the wrong people?

Seriously whatever creditability they had, they've completely lost it.

Thank goodness the footy is back in May 28.

I watched the press conference and at no point did Hazzard say he'd oppose the NRLs return. He said he hadn't spoken to the NRL, would be happy to meet with them and its important for society to get back to some sort of normality in the coming months. A reporter yelled out " do you think its safe to put your head in a scrum " and Hazzard rolled his eyes and took the next question :D
The undisputed king of league bashing is Peter Fitzsimmons. A few weeks ago he wrote how dare league ask for government assistants yet 1 week later wrote the government must step in and help Rugby Union because of how important the sport is to Australians. C'mon Pete, a bit of biased ?

Apparently listening to radio the NSW government today will announce that the Corona cases have jumped by 25% .....

So it just sounds like the increase was due to testing of the staff on the Ruby Princess. 36 of them tested positive. So it is still coming down.

I don't think they will be included until tomorrows numbers but the increase wasn't massive by any standards. Tomorrow there will be a spike due to the Ruby Princess!

There are more recoveries than active cases across Australia and in Victoria alone there are 926 recoveries out of 1241 total cases. Things are improving every day. Obviously we can't go back to normal just yet but when the Deputy Chief Medical Officer is saying that we could be 'on the cusp of slowing infections of coronavirus to the point that the epidemic dies out' it's very promising. Everybody just needs to keep doing what they're doing.

Today I went to the local fish and chip shop and gave the owner Constantine absolutely f**king hell for spending the money I've given him over the years when buying my Friday feed of kransky and scallops.

How dare he spend money he's earned on things he wants.

Obviously we can't go back to normal just yet but when the Deputy Chief Medical Officer is saying that we could be 'on the cusp of slowing infections of coronavirus to the point that the epidemic dies out' it's very promising. Everybody just needs to keep doing what they're doing.
Does that mean 926 people have recovered and there are still 1241 active cases or that there is currently only 315 active cases? if so thats only 0.005% of the population

Ive been all for lockdowns to stop this spreading, but if thats the case and numbers are already starting to plateau I don't see how this can last 6 months

Certain restrictions will remain in place for a long time, but other will be loosened if we continue on at this rate. The social distancing rules will still apply but we may be able to get back to a point where people can gather in small groups again.

302 active cases (926 recoveries and 13 deaths) with only 43 of those people in hospital and 13 in intensive care.

That 100 indoor. 500 outdoor would be a nice mix. Allows more things open
