Mirvac moves to seize Tinkler's assets

Property giant Mirvac is going after the assets of mining magnate Nathan Tinkler after he failed to pay a multi-million dollar debt.
Mirvac arm Domaine Steel River sued two of Mr Tinkler's companies after they failed to honour an agreement to buy industrial land in Newcastle
Mr Tinkler was given a court-ordered deadline to pay Mirvac $17 million by Monday of this week.
But the deadline was missed and Mirvac has told the ABC it is now exercising its full legal rights to get the billionaire to pay up.
Mirvac says it has lodged a contempt of court order to sequester Mr Tinkler's assets
Mirvac has served a number of documents on Mr Tinkler's companies and they will be returnable when the matter's heard in the Supreme court on Monday.
Mr Tinkler's spokesman has refused to comment on the Mirvac matter.
Mr Tinkler denies he is in financial strife despite his failed takeover bid for Whitehaven Coal and a proposed mass sell-off of horses from his Hunter Valley thoroughbred stud.
Several Hunter businesses have also claimed they are owed money.

They are in a bit of shit, I doubt this will put them in danger of folding. They will just be back to square one?

After what we've been through I hope the Knights have some kind of damage control planned.

Simple rod thinks a bank guarantee is actually from a bank.

Um if Tinkler can't pay the 20m then the bank pays it mate.

As for folding or back to square one, docbrown explained it in the NRL thread on this best so I'll just steal it from him:

So the worst case scenario was always:

* Tinkler owns the club for 2+ years
* The club has about $6 million of debts cleared
* The club gets $10 million
* The club is sold back for $1
* The Knights have to find a new ownership model


The old club directors were adamant on putting these failsafes in place when the deal was being negotiated, should things go south for Tinkler. They did well.

Timing appears to be the critical factor in that scenario though Rod. Do you know if that happens immediatley or do the club have to wait for certain proceedings before getting the dough? I presume the 20m G'tee is backed by some kinda of liquid(ish) security to help the bank find their wallet so to speak. It's been ions since i've had anything to do with G'tees so i'm not sure wether the payment can be held up pending realisation of assets or wether it's claimable on demand. I suspect the bank have "insured' the event with Tinkler paying the premium. That might slow things up a bit but I realy don't know. Feel for the fans ATM.

ALARM bells are ringing over the future of the Newcastle Knights under the ownership of embattled mining magnate Nathan Tinkler following revelation the club has fallen behind in player payments.

Leaguecentral.com.au can reveal this morning that the monthly salaries have not been deposited into the players’ bank accounts on schedule this morning.

Superannuation payments and office staff salaries have also been delayed in recent months.

A number of players phoned their agents to say the payments due on the 15th of each month had not been paid yesterday

The money had still not been deposited this morning.

Hunter Sports Group spokesman Richard Fisk denies there is a problem.

"I accept there has been tardiness in the past," Fisk said.

"But all pays for Jets, Knights, HSG employees have been processed and will clear today in the normal course of business."

When trying to contact Fisk to quiz him about payments, he texted this reply: "Not late. Obviously confusion over weekend. Wages not late processed on 15th and will clear today. We are probably waiting on All Too Hards prize money from the weekend...lol"

The crisis involves many of the biggest names in the game including skipper Kurt Gidley and club veteran Danny Buderus.

It is not clear if super coach Wayne Bennett has been paid.

The now Singapore based Tinkler was once rated Australia’s richest man under 40 by Business Review Weekly.

He purchased the Newcastle Knights and hired super coach Wayne Bennett on a deal worth more than $1million-a-season.

Part of the deal negotiated by the club’s former CEO Steve Burraston ensured a $20 million bank guarantee was part of the deal.

The NRL has again been caught on the hop over the club’s finances.

I recently asked acting CEO Shane Mattiske about rumours of the Knights’ financial crisis.

"We have been assured by the Knights that there is no issue," said interim CEO Shane Mattiske.

"In our monitoring of the club's finances, we've seen no evidence that would suggest we should be concerned. We understand that some of the media reports are clearly going to lead to speculation.

"We continue to monitor the Knights, as we do all clubs. It is important to remember that there are also a number safeguards that were built into the original transfer of the licence to Hunter Sports and these remain in place."

Not a good look. Maybe I am the only one but I would be super pissed if my pay did not go in on time and my CEO was using "lol" in a statement about it.

What do you expect him to say?

Staff working for Tinks havnt recieved super for a long time now.

Maybe the superstars and coach etc are being looked after but I can imagine the rest of the staff are getting very nervous.

The bloke is in massive trouble. He borrowed massive amounts on the back of a coal price that has since bottomed out.

Me thinks, if things were starting to stink for Newcastle, they are getting very close to rotting by now.

How will all this pan out for the Knights. What safeguards have they got if the fat prick falters on his committment.

The former mining magnate's private horse racing trainer, John Thompson, revealed his stable of Mr Tinkler's horses had been forced to go without feed because the group was unable to pay suppliers.

''I've gone weeks without vets, farriers, bedding and ran out of feed a number of times,'' Thompson told Sky Sports Radio on Sunday.

As if admitting to being unable to care for Mr Tinkler's horses properly was not enough, Thompson also confirmed racetrack rumours that Mr Tinkler's racing and breeding company, Patinack Farm, had been kicked out of its Hawkesbury private training facility because "the owner of the property just got sick of us being late with our rent".
