Surely the club can counter-sue him if it is ruled that we did not defame him. It's patently obvious that there was no mention of his name or suggestion of any illegality in the comments / interview attributed to Beeker.

A PHOTOGRAPH taken by Cronulla officials of a vial marked "For Equine Use Only" during Stephen Dank's time at the Sharks could be used as part of the club's legal defence after the sports scientist yesterday initiated action for defamation.

Dank has issued a NSW Supreme Court statement of claim against the Sharks and former chairman Damian Irvine, who was forced to stand down after he had claimed that players had been injected with horse drugs.

Other defendants named in the lawsuit include the Nine Network, Nine journalists Peter Overton and Sarah Harris, and The Daily Telegraph and The Sunday Telegraph's sports editor-at-large, Phil Rothfield. The matter is listed for hearing in the NSW Supreme Court on April 26.

The Australian understands a player questioned what equine meant after a substance was administered to him in 2011.

The player was ridiculed by his teammates for his ignorance.

Officials took a photograph of the vial in question and it formed part of a report by retired judge and former deputy chairwoman of the Australian Sports Anti-doping Authority Tricia Kavanagh that led to four officials being sacked and head coach Shane Flanagan being stood down for failing to report alleged practices to the board.


The Australian understands the maximum damages that can be awarded to a plaintiff in defamation proceedings is capped at $339,000, but Dank is also seeking unspecified special damages and costs.

The Sharks are in debt to the tune of $3.5 million and can ill afford expensive litigation or a payout.

It is unclear whether the lawsuit will affect Irvine's decision to renominate for the board in next month's elections.

The statement of claim alleges that Dank "has been greatly injured in his character, credit, business, personal and professional reputation and has been brought into public hatred, ridicule and contempt".

Dank's legal action stems from an interview that Irvine conducted with The Sunday Telegraph that was published on Sunday, March 10.

The Nine Network carried a report into the matter on its news bulletin that night.

The interview was conducted following public outrage over the board's decision to stand down Flanagan and sack football manager Darren Mooney, trainer Mark Noakes, physiotherapist Konrad Schultz and doctor Dave Givney. Givney and Schultz have also threatened to take legal action against Cronulla.

Dank has maintained his innocence and says he was defamed by claims in The Sunday Telegraph report.

Dank has been mentioned in reports since the Australian Crime Commission announced last month that an investigation had revealed that doping, organised crime and match-fixing were rife in Australian sport.

Dank is under scrutiny from ASADA for his involvement at the Sharks and Manly in the NRL and Essendon in the AFL.

The federal government is trying to push through legislation that would force him to co-operate with the investigation

His solicitor, Raed Rahal, has filed a statement of claim in the NSW Supreme Court against the broadcaster, as well as news reader Peter Overton, reporter Sarah Harris and News Ltd sports journalist Phil Rothfield. The claim, filed by Mr Rahal on Tuesday, is also made against the Sharks and their former chairman Damian Irvine.

Just listening to Alan Jones speaking about this business. He says ASADA have no evidence against anyone but are trying to intimidate players so the Federal Govt. can get a scalp or two to justify their accusations made at the original news conference. They don't care who they hurt to sate their power lust. It's a damned shame that the main entity they are trying to hurt is our club and it's supporters.
`Whatever it takes'............I just pray our club isn't part of the `whatever'.

If Dank wants to sue someone for damages to his image, it should be ASADA & no one else. Sharks weren't the ones to reveal him.

Can anyone else see some kind of major investigation done into this whole affair once it's run it's course? I suspect heads will roll.

OT: In the first story.

Remember when a sentence like that was spoken or written it said 10 or 12 million.

Good to see filthy Phil is one of Danks targets. No surprise that Wierdler is not mentioned.....must have copped a load instead. May not be a bad thing for the Sharks if he is proclaiming his innocence.

I am really interested to hear the explanation of a bottle (photographed) marked equine use, not fit for human consumption and how it turned up our club, why a player asked what "equine" means and why our doctor and staff reacted with Mr Dank being requested to leave.

Equine-use-only tag a simple mistake

A substance marked ''for equine use only'' allegedly provided to Cronulla players by sports scientist Stephen Dank is the same product regularly used by bodybuilders and other athletes.

Sharks officials have taken a photograph of a product that they will consider using as part of their legal defence after Dank initiated defamation action against the club and former chairman Damian Irvine.

In a newspaper interview, Irvine said Dank injected players with ''equine substances''. The fallout ultimately cost Irvine the job, although he will stand at this month's board elections.

It is understood the substance in question is gamma oryzanol, a rice-bran extract. A legal supplement, it is often provided to livestock and athletes involved in strength training. It's understood Dank received half a dozen bottles - which retail today for about $100 - from a supplier called Away Australia. When the shipment arrived, five of the six bottles were labelled for human use, although because of a dispatch error, one of the bottles arrived marked ''for equine use only''. All six bottles contained the same substance, or same formulation, and only the labels difffered.

As a food supplement, it does not require Therapeutic Goods Administration scheduling or listing with the Australian Pesticides and Veterinary Medicines Authority.

Fairfax Media understands to placate then trainer Trent Elkin, Dank offered to return the bottle labelled ''for equine use only'', even though he assured him it was the same product.

Elkin declined the offer, saying he was happy with the explanation.

It is understood up to half a dozen Cronulla players used the supplement. It was also part of the range of products used by Manly players during Des Hasler's time at that club. On the website of the American supplier, Equiade, it is described as ''Body Builder™ Horse and Dog Supplement'' (pictured) and the benefits are listed as: ''Body Builder is a natural dietary supplement for horses, dogs, humans and livestock animals. Body Builder is one of the most effective dietary supplements used by owners, breeders and trainers of horses and dogs.

''The main ingredient in this product is of pharmaceutical grade, meaning it is in the purist form. Racehorses and dogs that are on our supplement have healthy coats and are beautifully muscled. Many have tried to duplicate this product with inferior results. This is due to our secret formula, superior ingredients and special process in manufacturing Body Builder. See for yourself and you won't be disappointed in the results. Body Builder comes in 8 oz and 32 oz sizes.''

Dank named other defendants, including the Nine Network and News Ltd, as part of the lawsuit. The matter is listed for mention in the NSW Supreme Court on April 26. While defamation proceedings are capped at $339,000, Dank is also seeking unspecified damages and costs.

A successful legal challenge would cripple cash-strapped Cronulla. The Sharks are the only NRL club without a main backer, while other key sponsorship properties, including naming- rights for their home ground, remain unsold. There is also the prospect of the players taking legal action against the club pending the outcome of the Australian Sports Anti-Doping Authority's investigations into doping and the integrity of sport.

If this whole case was based on the back of this wrong label, then ASADA should be investigated, from the PM down to the last shitkicker.

The longer this has gone on, the more and more watered down and less serious the whole situation seems to get.

If its found that no Sharks players have done anything wrong, then the Sharks should seek compensation, because their image has been destroyed by this bullshit investigation.

For a case that wasn't meant to have any details go public, there's an awful lot being reported. Either ASADA leaks like Kevin Rudd, or their investigators are bigger hacks than Danny Weidler, Paul Kent, Phil Rothfield and Dan Ginnane.

Which should be grounds enough to have them shut down for gross incompetence.

I bet this is exactly what has happened. It now appears there is no informer & the ACC information on non-illegal activities cannot be passed on to ASADA.
So no matter what player X has said on his phone, it cannot be passed onto ASADA.

Mate, when paid staff fail to report ... injecting players with equine substances, I can't help (Editor's note: the staff have denied any knowledge of this). Players deserve professional support, not people who risk their careers.
