Has anyone got a repsonse from the club. When i asked, all I got was that they are consdering wether to appeal or not.

Jess and I spoke to Chris Judd (Parramatta Lawyer) last night after the game. She posted what he said but basically they had to consider if it would happen. Problem was they had to turn around and say that while the defence was that he didn't him, he did actually hit him but not hard enough to warrant a nine week suspension. This had to be prsented to Justice Woods who is the judiciary chairman and he can then decide whether the sentence was harsh given the new evidence and then they work from that.

I guess if they said they would decide today and there has been no news as yet. I will assume that there will be no appeal.

If they decide not to appeal will there be a press release? Or is that only if they decide to do so? Is it confirmed there will be no appeal?

We might know when the smh and tele come out with the news at midnight

Most likely theres no appeal. I think we would of heard some news if there was

I think it's more that people might jump to the last page of a thread if they don't have time to backtrack everything - I too saw Colonel's explanation before I saw your (earlier) post.

Or Jess, maybe you could change your name and identity to something like ButchEel, and get an automatic credibility boost? ;-)

Moimoi to appeal suspension

Parramatta has today sought leave to appeal the nine week suspension handed down to second rower Fuifui Moimoi last Wednesday.

The NRL Judiciary Chairman, Judge Greg Woods, will consider the club’s written submission along with submissions from NRL Judiciary Counsel Mr Peter Kite SC.

Judge Woods will determine if it is an appropriate case in which to grant leave to appeal.

The time taken to determine this will be at the discretion of Judge Woods and his judgment will be issued by way of an NRL media release.

The grounds for granting leave in a judiciary appeal are as follows:

(1) With respect to the issue of guilt:
(a) That there was an error of law; or
(b) That the decision was unreasonable or insupportable
having regard to the evidence in the case
(2) With respect to the issue of sentence, that:
(a) In the case of a Notice of Referred Charge, the penalty
imposed was manifestly excessive;
(b) In the case of a Notice of Charge, the grading ascribed
was manifestly excessive.

Should the Judiciary Chairman grant leave to appeal, the Appeals Committee chaired by Sir Laurence Street would be convened at an appropriate time.
