He wasn't cleared, he was not charged. Police don't charge people they know committed a crime all the time, because they lack evidence admissible in court.

Its also the reason women press civil suits. If your raped in a room, and your rapist days consent, how do you prove otherwise to a criminal law standard?

Often it's make a civil case or walk away. Most walk away.
