Tribunal finds calling someone a 'Kiwi' does not count as racial discrimination

A NewZealand worker has lost a racial discrimination case against an Adelaide bakery where she was nicknamed "Kiwi".

Key points:
  • Julie Savage alleged she was shown disrespect by being called 'Kiwi'
  • Her employer Vili's argued it was a term of endearment
  • The employment tribunal found it did not amount to discrimination


TheSouth Australian Employment Tribunal (SAET) found Julie Savage was not discriminated against while working at Vili's Cakes and that "Kiwi" was not an insult.

Ms Savage alleged Vili's managing director Vili Milisits called her Kiwi while she worked as a supervisor at thewell-known industrial bakery in 2016, which prompted others to do the same.

It might not be racist but it could well be derogatory. Without knowing any more it's impossible to say how it was used. I can see how some people in that situation would have a legitimate complaint, but arguing that it was racist was probably not the best legal tactic.

I guess it might be racist if they were referring to the brand of shoe polish.

But we don't have an anti-derogatory comment commission yet, but when we do I'd hope they'd start with some more serious cases. Like that of my PA, Yarpie.

It’s a pretty well known fact that New Zealanders are known as Kiwis. She could have just said to her coworkers that she was offended by the term and could they please not call her that.

Maybe she’s just embarrassed that she’s from NZ. I mean, they do have that ridiculous accent.

Researchers for the NSW RMS found over 200 dead crows near greater Wagga recently, and there was concern that they may have died from Avian Flu. A Bird Pathologist examined the remains of all the crows, and, to everyone's relief, confirmed the problem was definitely NOT Avian Flu. The cause of death appeared to be vehicular impacts.

However, during the detailed analysis it was noted that varying colors of paints appeared on the bird's beaks and claws. By analyzing these paint residues it was determined that 98% of the crows had been killed by impact with trucks, while only 2% were killed by an impact with a car.

RMS then hired an Ornithological Behaviorist to determine if there was a cause for the disproportionate percentages of truck kills versus car kills.

The Ornithological Behaviorist very quickly concluded the cause: when crows eat road kill, they always have a look-out crow in a nearby tree to warn of impending danger.

The scientific conclusion was that while all the lookout crows could say "Cah", none could say "Truck."

Lol. Yeah I agree. The term isn't racist or inherently derogatory. But it could be used that way. And for all we know she might have objected.
