It’s a conundrum for the Minister for Home Affairs now. Election around the corner. Will she make a strong borders decision or will she cave on the basis of compromise and allow the guy to remain because it’s just 3 weeks ?

The Feds will also consider the law of precedent. If they let this one go and not fight for their right to control borders, what happens with the next person who crosses the border without complying with rules?

I suspect that the judge felt that it was equitable to take the stance that “you emailed him and said his visa was approved. Let him play tennis FFS.” However there are deeper immigration and biosecurity issues at stake here.

I doubt your general immigrant has the money or English skills to take this to court and fight their case.

Well maybe we should rework the system so so that those who aren't being treated justly now, can in the future. Instead of treating everyone unjustly so the less well off don't arc up.
