A question for you legal eagles.
My daughter just bought a car from a friend in Melbourne. She got a good deal, $2000 when it's worth about $4000. She hasn't got the rego put into her name yet and hasn't insured it yet.
This morning a drunk driver took out her car and four others while they were parked on the side of a road at a soccer game. The car is a write off. Because of that she won't be able to change over the rego as it has to go over the pits when changing from interstate.
Are we in a situation where we have to sue this bloke who was pissed and not covered by insurance?
Are we likely to be stuck with nothing?
The friend she bought it off hasn't taken it off his insurance yet and I guess the rego is still in his name until my daughter does the changeover.
I'd ring the insurance company and see what they have to say. This must happen every now and then. If the car is still covered financially, and you haven't been too tardy in getting the rest of the paperwork completed you might be ok.
How much time elapsed between the purchase of the car, and the 'accident'. Has the vendor submitted a 'notice of disposal' to the registry?
No he was waiting for us to send back the plates.
For all intents and purposes I think the car still belongs to him and is under his insurance.

How much was it insured for? ... the dude could make some $s out of it if its a write off. ie more than 2000, he gets his insurance to pursue the dude, if not at fault then there would not be an excess claim i dont believe ... he gets the writeoff value, gives the 2000 to your daughter and keeps what is left for himself ... your daught at least breaks even, he makes the difference
Tho my concern is he's in melbourne yeah and the car was taken out a long way from there
