Legal fees to dispute it $1100.00

Cost of infrigement- $300

I think i know what option id take.

How much is the mans reputation worth. There is absoluetly no way that he will admit to it.

The matter will be withdrawn within a couple of days - you can bet your house on it AND the obviously very young contstable who laid the charge may be asked to re read his law books.

Geeze I hate those self serve scanners.

At Rosehill, they basically force you to use them by only having a couple of registers open. All about saving a bit of change for their shareholders

I went in there once, one of the scanners was "out of order" another scanner couldnt input fresh produce (fruit and veg), someone using another scanner was having problems, so the queue was about 10 people deep for one scanner

and yup line as long as the day in the only rwo registers working

Ok Im not a lawyer but even I would be able to successfully defend him. Easy.
No intent, honest AND reasonable mistaken belief in the facts.

Pick me Ozzy !!!

If the barrister that the eels got for Hayne can get him off that headbutt, getting Ozzy off this trumped up stupid charge would be a snap.
In fact, if the NSW police DONT withdraw the charge, then Ozzy should sue the police officer concerned and the NSW Police.

lol

Im not a lawyer either but it sets a nice precedent for others to use the "forget to pay" escape clause

Pay the $300, your mistake son

why the NSW police? - wouldn't it be Woolworths' decision to pursue it or not?

Disgusting act of thievery by Osborne. I wouldn't be surprised to see a player walk out over this. It's time to take a stand against thieves.

Your kidding right ?
The law is the law.. its designed specfically to excuse accidents.
No intent - no cupability.
End of story.

yes it is.
Woolworths make the complaint and the Police then judge if there is sufficient evidence to place that matter before a court.
The police have the ability to refuse to proceed with the matter, if there are any exculpations.
This is exactly what Ozzy has done. He has requested that the NSW police use that power to drop the charge.
People walk out without paying all the time but if the crown cannot prove an intent to steal then its merely an accident.
How do they prove this intent ? They investigate the incident, interview the suspect and then make a decision having regard to the totality of the evidence if they can prove the suspect intended to steal the item or it was an accident.
Dont forget this proof is 'beyond reasonable doubt' which is basically 99.99%.

Not a chance.

Oh and my legal bill is on the way...:D

Oh By the way... Woolies can withdraw their complaint at any time too.

yeah - as i said, woolies made the decision to take it to the police - i don't think the day-to-day police should be making judgements on what they then pursue if woolies are saying they want it pursued ..... cops are just doing their job here - its those big bloody grocery chains that we need to vent at :fist: .... screw you Woolworths!!!
