That's not to say that she was not drugged, or otherwise. But whatever the crux of her argument is, she definitely has a legal leg to stand on. Laffranchi could be in some very serious trouble.

I dont know about some people here, but I have been really really drunk a few times and I never suffer from temporary amnesia. I have had trouble being able to see but I have never had memory loss. The only way I personally can understand not being able to remember a whole night is from drugs (not that I have ever used drugs).

Serious question, has anyone here been so drunk that they could not remember a whole night, nothing from it?

This case reeks of a woman who was tarting around football players, goes back to a house party, gets blind drunk, has a one night stand and then gets the guilts in the morning.

The fact that Lafranchi is somewhat famous probably sealed the deal in her squealing rape. The evidence that has been released to the media doesn't prove $hit.

I have on a few occasions.

Once on schoolies, once after my mother's funeral, and once a few weeks ago.

On each occasion I have lost a good solid 4-5 hours of memory.

Probably why I have stopped drinking.... :lol:

It never ceases to amaze me how whenever any allegation is made against a footballer how many people on these forums bend over backwards to acquit them without knowing anything other than newspaper extracts.

And some of the comments on this thread about a person who has sworn on oath that she believes she has been raped are very very ordinary. Especiallythe suggestion that a woman who hangs around with footballers and/or consumes alcohol deserves any consequences, or provokes them.

If a woman is so drunk that she CANNOT give informed consent, then there is a real chance that a finding could be made against the man involved.

I dont know the details of this case, but I would imagine that the police would have physcial evidence before seeking a prosecution.

Not in any way commenting on this particular case, but someone charged under these circumstances could find themselves in a heap of crap.

Prosecution will try to prove:

1. The woman was too drunk to offer informed consent
2. Intercourse took place

Really, that's all they have to do.

I mean, if being drunk can make a woman not responsible for her actions, then surely a man can be extended the same courtesy

Johnsy I think made that point earlier, good point it is too....poor old furry couldnt quite grasp it though.

Yet apparently she was able to manage to make 21 phone calls and also several cab trips.


And yes, Ive blacked out on the booze...not a nice feeling, trying to piece together movements the next day and only managing to recall half the night...apparently you can function quite normally during the blackout, you just forget all about it later

I can`t remember reading any cases that dealt with this, but I would imagine it`s more to do with the ability to reason than the ability to function.

Significant difference, when you think about it.

Oh piss off :lol:. How is it the same courtesy? The woman is too drunk, but she isn't breaking the law or raping anyone. It isn't an excuse... Its a f**kin dumb argument- opens a pandora's box for every crime to be legalised because someone can just go "Oh I was drunk and had no control...". It doesn't make it ok. If you are gonna get like that when you're drunk, dont drink.

Everyone condemns the victim on these forums and finds a way to glorify the defendant without knowing any of the details.
